I have a question for you...when you were 1st injured, did you file with the state? I ask because for the 1 1 1/2 years after my injury, I assumed that since the employer had filed, that was all that was needed. Luckily for me, I got a lawyer about that time and she told me that if I did not file myself within 2 years, the i/c would not have to pay for my medical any more. I had no idea that I needed to file a seperate form with the state. Just thought I would ask.

I hope you have a good lawyer. I am in the same situation you are. I had a 3 level fusion . My injury was Apr, 2004. My lawyer is going for a wage differential case. I can only find a 10.00 per hour job and can only work part time due to my pain. I am making 850 per week less now. My lawyer does a lot of work with union trades people. The ttd payments will not be taken out of your settlement. I also live in Illinois.
so u have been getting paid since 2004?when u went back to work are u still making 66% off your pay before u got hurt?what kind of #s are u being pffered?do u mind me asking?(over 300.000)

We are in settlement talks right now. The insurance company wants to settle the case. My attorney asked for a little over 400,000 and the insurance company offered 120,000 the first time. They agreed that I was 40% permanently disabled. Plus they have to have a medicare set aside account set up for me for my life. My drugs alone run about 1500.00 per month. And my life expectancy is 27.4 years so the drug set aside alone will be huge. I am on social security disability. I am only 54 and have been on it for 2 1/2 years now. I think they will settle the case between 250-300,000 plus the medicare set aside. They have already spent over 350,000 on my medical and ttd payments. I am working 12 hours per week and the insurance company pays me the difference to make up the 66 2/3 of my pay.

on the settlement im not sure but i would not settle with out med.because just my surgery was close to 200,000 thats not meds,dr visits,co-pays,milage,so on.if you would need surgery in the future it could wipe you out,it is very exspencive.

Each day is not a rite,it's a given.
