is it too late to file?
So about a month and a half ago i had got a work related hernia lifting a bucket of ice. i did not notice it at first because it was only minor. then a week or so later i then started to feel the pain and then noticed a bulging in my lower abdomen. still not sure wat it was. i dont have health insurance and i went to a doctor. said i had a hernia. this is about a month later at this point. so now is it too late to get workmans comp if i need a surgery.???

You need to report it at work. Did you go to the doctor yet or ER to get it checked? Did you say it was a WC incident? If not, you should mention it to HR so that the proper paperwork could be filled out.


I would say use you own health insurance because once you get into the WC system they can give you such a run around that it could take forever to get the surgery. But after reading you do not have insurance then you may have no choice than to claim it as a WC injury if it happened there.

After being in the WC system, I have learned so much about how they treat injured workers that I would do anything possible to not get myself involved in this system again. My accident happened at work and I was forced to sign the paperwork. NEVER AGAIN!

I wish you luck and hope you get the surgery fast!

If you didn't say anything to anyone at the time, it could be a problem linking to work duties but it's not beyond the tme limits.

well i dont have any health insurance at all... i dont work at the job(worked at a local pub as a waiter) i got the injury at because they fired me because i was sitting down in pain from my injury. i have a feeling that it seems out of question to get any type of compensation. so my plan is to now try and get a job at the hospital workin in ER registration and possibly get my own health insurance. sounds like a plan. anyone have any incite let me know what you think, im desperate for any advise. thank you everybody for your comments

I would schedule an appointment with a work comp attorney about your injury and see what "they" say.
This appointment should be free and will help you make some decisions.

You should go ahead and file the claim even though it is after the fact. Did you tell them you had an injury at any time? When you went to the doctor what did you tell him about the injury? When they let you go what did they give as the reason? Since you did not file the claim immediately you can count on them questioning it's validity.

You schedule an appointment with a WC lawyer by picking up the phone and calling one.

The question still is, did you tell anyone about your injury at the time it happened?
