I sure hate WC. If I could have gotten away with this on my personal insurance, I would have done it.. but it is to late now.

My symptoms in my right hand,wrist, arm and shoulder actually began back on February 6th, but I blew it off thinking I had just slept wrong the night before. As time went by, my pain got worse and I turned it in to HR on the 20th of February, but they reported to WC that I didn't say anything to them till a week later on the 27th which was a lie. On the 19th of March, I found out that my claim had been denied by the IC adjustor because there was no medical evidence because I hadn't seen a Dr by then. Duh.. by the time the adjustor was done jerking me around, no Dr's in my area would touch me. So I had to hire an attorney almost 130 miles from me...and a WC dr that is 119 miles away.

In the meantime, my attorney set me up for a DDE that will take place tomorrow afternoon at 4:15 here in the falls. I am going to fight to stay at work all day so that he can see how my hand, wrist, arm and shoulder are after sitting at a non-ergonomic desk typing all day. I don't think that there is any way that he will be able to deny that this is an occupational injury/cumulative injury that happened over time while at work. If he is in my corner (I have talked to him over the phone when I had to reschedule three times) then we are sure that the IC will appeal. If he goes against me, then I will be appealing. We (my attorney and myself, along with the Dr in Ft Worth that has agreed to treat me) have talked and decided that we will fight this till there is no longer any place that we can appeal to.

Keep your fingers crossed that this DDE will be in my corner (after all, it was my attorney that set this up) and that it will be the IC that has to file appeal after appeal and that they won't make me sit through a DDE of their choice. In the meantime, I am waiting for the state of texas department of workers compensation to allow my Dr to become my treating Dr. It has been over 2 weeks since the paperwork for that was sent in, and according to the State of Texas DWC, they are backed up on making these decisions in my local area, so the Dr's assistant sent it to the Ft Worth branch to try and get them off of their duffs to approve or deny. I hope that something breaks loose soon before I loose the entire use of my hand and fingers. It is getting worse with each day.
