Workers comp settlement
Well I'm a little upset and don't know what to do .i received a letter from my ajuster saying they want to settle my claim , and I have two options one they finish paying me my temp disabilty til they've paid a total of $16,000 or I can quit my job and they would give me a larger settlement .This is all bull *****edited by admin***** I had carpal tunnel surgery and now I'm in more pain then before .And I'll be in pain the rest of my life and this is all I get.I feel they owe me sooooo much more because this job caused this and I'm going to be in pain the rest of my life .Oh yea and if I want more money I have to quit my job yea right as hard as it is to find a new one and at my age (53) they have to be smoking crack.Does anyone know what I can do if anything at this point????? please help

workers comp disability benefits are set by law.
each state has a different system; some very objective others have more subjectivity and more open to negotiations. In some states attys can make a big difference in the settlement amount; others not so much. It's pretty standard that an employer won't give a lump sum and also allow you work and possibly file another claim. you don't have to prove negligence or fault unders workers comp and the benefits are set by law with the majority being paid in medical and wage replacement and only smaller amounts for impairment(depending on the state). without knowing your jurisdiction specifics can't be given. |

Think they are starting the negotiation phase of the settlement. Not sure how that works in CA, but in most states since your not represented - you still may be able to counter.
You stated on previous post that the QME gave you a rating of 22% - is that to the body as a whole or both hands? |
