Industrial Disabiity retirement???? PTSD
CA RN. I am unable to return to my position due to a work related injury, All attempts for reasonable accomodation have failed in order to return to my state position. I am 49. Do I file for industrial disability retirement or wait for the state to initiate it? If I file for Industrial disability retirement and it is denied, am I forced to take the disability retirement which would result in a significant reduction in benefits? My TTD runs out in March 2010.

you should start your own thread so it'll be less confusing to the many readers who visit this site.
Industrial retirement rules vary with the different agencies and is totally different from the state's workers compensation insurance laws. I don't think either option is mandatory; you could quit without applying for either. generally I believe that most agencies require the worker initiate the application. |
