guess what!!!!!!!!!
Hello everyone, well went to our local ssi office today ( 40 miles away ) to get things lined out for my kids to draw off of my disability and I found out that ssdi seems to think I was still drawing workman's comp, which is why they are taking a big chunk out of my backpay plus deducting over 800 a month off of my disability checks, I got my last wokman's comp check in may of 06 and settled a few months later.So I had to call my lawyer to fax them a copy of the judge's order and when I actually settled with wc.So they said they will correct the mistakes.Still have not gotten the first check they mailed to me. Now for the question, does it sound like maybe my lawyer screwed up and didn't give them the correct dates of when my wc ended?What a day sounds like the government is just as screwy as wc.Thanks for letting me vent.Halftrak

No, I don't know where to point that blame, for I had brought in 3 copies of my last WC check, and I still had to bring another one in. Just goes to show you, the same things seem to happen to others, and there the same issue also.

I am on SSD, approved 39 days after my initial interview.
I selected to go to the have my interview at my SSA office so my SSA case worker would have a visual of me. At the interview my SSA case worker was given information about my wc payments, also gave him my attorney's name. He got on line found the phone number called attorney's secretary requested break down of wc benefits to be faxed. This & completed during my interview. At the time I knew I was close to being released by wc dr & checks stopping. I told this to SSA case manger, he told me have your attorney send him a termination letter. I did that.day the dr release me My SSD benefits started one month previous to being released from wc dr. and was back dated five months. I would think your attorney did his job, call the office and request secretary pull your file, and the letter should be in it. Give her the name & number of your SSA case worker and request the information be sent a second time. I requested my attorney's office to do this when my wc payments stopped and they were happy to do so. Many wc attorneys also represent individuals that have applied for social security benefits... |

I think if anyone made a mistake, it was SSA. When I did my interview, one of the main questions asked was about receiving w/c payments. It just sounds to me like something didn't get put into the system that should have. I'm glad you got this straightened out, and you will have some funds coming to help you and your family!! Well, I got some backpay yesterday.Yeah!!!!I did have my lawyer send the ssa the copy of the settlement that I got from workman's comp.I also had went to my former employer and got them to put on a letterhead when I was on workman's comp, start and end dates. I have that for them if they need it also.If I am understanding correctly they still owe me some more back pay for at least a year.I'll call them at least once a week to check on this.It just seemed like my lawyer should have had all this taken care of, don't you?Thank all of you guys for your help and opinions, Halftrak

Good morning halftrak.......Just wanted to tell you that SSD messed my husband's paperwork up horrible. We still haven't gotten asnswers BUt his attorney had all his ducks in one basket. It was on SSD's part that the mess began and now no one seems to be able to sort through it. Since he wasn't awarded SSD until after settlement they had a copy of all WC checks and his settlement papers. They still messed up and now can't seem to figure it out. I'm glad it all worked out for you.CAP

Well, I am supposed to get my first check in June but before I discovered the srewup they are deducting almost 800 dollars out of my check, this is why I want it straightened out.My kids are eligible foro ver 300 each to draw off of me but if it isn't straightened out they will only get 11 each.See what I mean?Thanks
