Just Curious!!
First off we live in South Carolina. My husband got hurt on March 29th at work. We found out that his manager did not pay his workers comp bill so he has been without workers comp since december. I just got the letters that the lawyer we hired sent in yesterday. They checked the box on the Form 50 for us to have a hearing. Does anyone know how long it normally takes to get a hearing? I am pregnant and we are running out of money fast because my husband still hasn't gone back to work. He finally gets to start back on Tuesday.

sorry dont have a clue on how long it takes in your state to get a hearing .. what does your lawyer say ?

It would depend on how backed up the court system is.
8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |

hate to tell you but you could be in for a long road.my court dates have been put off 13 times yes you read it rite 13TIMES....... they can take there sweet time why bshould they care they get paid every week rite.it us that get the shaft and they dont care.not only that but i was hurt in 2005 i still not to court.good luck it might be a long road.
Each day is not a rite,it's a given. |

Some States have a Fund to Pay the Injured Worker if the Employer Defaults on their w/c Premiums. Check with Your State Bureau of Workers Compensation and See if Your State is One of them. Best of Luck, and Please let Us know what You Find Out!!

An employee may file an application for a hearing before a commissioner if the employer does not report the accident, if the employer denies that the injury was sustained in the course and scope of employment, or if the employee believes that he or she did not receive all of the available benefits. An employee may also file for a hearing if an employer does not begin compensation for more than seven days of disability within 14 days after the employer has knowledge or notice of the accident, or in the event payment is made, if there is a subsequent disagreement over the continuance of any weekly payment. The hearing will usually take place in the county in which the injury occurred. The decision of the hearing commissioner may be appealed to the Commission for review. A panel of either three or six commissioners, excluding the original hearing commissioner, will consider the appeal. The decision of the appellate panel may be appealed to a Court of Common Pleas and the State Appellate Courts.
