My doctors office called today as I had to send them the paperwork for getting medicaid insurance through the state. They said they can't fill it out legally because work comp payed for the IME. Then they told me they can't tell me even if he gave me a rating. What the he@@??????????????? I am the patient here and have no rights to anything??? They said that legally they cannot even send this report to my lawyer because it was paid for by work comp.
Has anyone else had any problem like this before??? I am so tired of all the games when all i want is to go back to work so I can live!!! |

ahhhhhhhhh yep their insurance their paperwork....what you can do is ask for a complete set of your records...I had mine faxed to my home because you asked for a complete copy of your records sometimes a lower not as savey person is asked to skim your records and she doesnt read just skims and you get a copy that way....this is where a lawyer comes in cuz they have to send a copy to your lawyer.....

Jayne.....who has to send a copy to my lawyer???? The IME doctor said they can't even send a copy to my lawyer!

I had my IME on April 3rd and just emailed my adjuster this week asking him for a copy of the report when it comes. He emailed me back that he will send me a copy when he gets it.
He did this also with the PIR rating. If they pay for it, they own it! That is what i was told when i personally went to the doctors office for a copy and they told me i had to go through the IC for the copy. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

This doesn't even make sense. If the IC intends to use the IME report in your workers comp case they are legally obligated to share that information with you. It's part of the "discovery" process. If they don't intend to use it that may be a different story.
Check your state's WC rules. If they won't voluntarily send you a copy you can usually subponea them. This is where a good attorney will help. |

I had a similar problem here in Illinois, I was seen by my employers employee health Dr for my initial injury, and my attorney had to go to court and get a judges order for my medical records, as he was told by the employee health clinic and hospital that my records were not mine but theres........... Go figure, but he finally did receive them.
Other records from my PCP were sent ASAP to my attorney. Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |

Usually I just go on w/c website, bring up my account and I can see all notes, payments, medical records etc and I can print them if I need to.

My attorney has always gotten my IME reports. When I want records I have requested them all and have gotten notes and all. I had to pay for them twice before. Nominal.Once was $25. I agree they are your records and if the IC or clinic or anyone else will not release them to you they should be releasing them to your attorney. CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |
