Anyone with a Prior back Injury that has settled??
I had a prior back problem 8 years ago but have had never filed a WC Injury because it happend at home.Have any of you ever had a pre-existing back problem and filed WC and had your hearing already?
What was the outcome of the hearing??

Hi! I had previosly injured the same area of my back that is now injured. The last time was four years ago and I did it at home. I was really worried at first that this injury wouldn't be covered, but so far they are saying it will be. I haven't had any settlement or anything yet. I'm anxious to hear what others will reply to your post. I hope everything goes well for you.

Hi all...my husband hurt his back 20 years ago and it was not in a w/c situation. He was in a motorcycle wreck. However, so far this has caused him a lot of trouble with the W/C IC. They are claiming that his his new injury was already there from when he had the accident 20 years ago. It doesn't matter than now it is in his cervical region and the back injury 20 years ago was in his lumbared region. The attorney tells him even it they were related which they are not, therer would still be something about aggravated injuries. I don't know if this helps are not. But it is all I know at this time.

I settled last week not near what the injury was worth but more than I expected but since I wasnt in it for the money....it was a blessing ......however I didnt have the back surgery it was decided by me and 2 docs that it would only make the injury worse.

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Morning born........In hubby's case they went back to when he was 18, now 50, and searched everywhere to find out IF he ever was treated for a back injury. Nothing was there so he settled. In my case this is my 3rd WC related back injury and I have been given nothing but grief by WC and my insurance co. No one will treat my back. personal insurance won't because WC paid on the prior two but they won't this time because there are 4 other body parts involved. Attorney told me IF you have a pre-exisiting condition that your job aggravates, it is compensable by WC. I know this didn't answer your question. Sorry, I got up at 4:45 with so much shoulder pain, couldn't go back to sleep, have PT at 7:00 and I guess had the need for human contact.

Born, With my first back injury ( hurt at work ) WC did not dispute, I did not know there was such a thing as settlement, was treated and went back to work 2 years later aggrivated previous injury, now fighting with IC as they are denying that the 2 are related, I even have letters from my Dr s stating that if I had not injured my self the first time I would not have the 2 injury, and the 2ed is work related. So the fight goes on.

Sorry Born, I'm going to my 8th hearing in June, it's been going on three years and the battle continues! I wish I could give you more info. maybe after this hearing I can let you know a little more!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
