Limbo maybe thats why I so want to hit that ball just need someone elses opinion on How to get hubby to agree ... Thats why I havent given up and continue to see doctors even when im the one paying for it ... thanks alot .... for I am a slugger !!! But hubby nevered played lol

Maybe you can print out some of our responses and let your hubby read them Was the lawyer that you spoke with a workers comp only lawyer?? The fee seems the highest that I have heard of, except for 3rd. party suits. I would try a differant lawyer for a free consult. This is just my opinion. I know it has to be hard enough on you dealing with your pain and the W/C, but it is even harder when your hubby doesn't want to back up what you want to do. Good luck sweety. I would just tell you to go and get a lawyer on your own, but since you live with your hubby, I wouldn't want to cause you any more grief, Keep us posted.

You hang in there and try and Stay Strong Tweety!! Persistence will Prevail! Maybe if You and Hubby would Speak to the Attorney, or another if Hubby is not Comfortable with the One You have been seeing, and try and see if they could Guide You as far as what a Settlement Amount May be Possible, If Your Husband Sees that the Attorney may be able to get You a lot More than You can on Your Own, He will See that the 33 1/3% to the Attorney is worth it. My Opinion Only, but My Attorney is getting 20% of any Monies He generates for Me, but the Expenses are Covered by the Losing Party. My Contingency Agreement Clearly States that if We Lose, I Pay no Expenses, My Attorney's Firm absorbs the Loss. It just Seems to Me that You can get a Better Deal by Possibly checking Out even a Few More Attorneys!! As Always my Best, and keep Swinging, there's a Home Run in Your Future!!!Smile

tweety00....tell hubby you need that lawyer to "even the stakes' as you can bet the IC has a team of lawyers helping them to get the best deal possible! You need professional, and knowledgeable help also .....so you don't get screwed in the end.

There is not a standard rate for an attorney in the state of Iowa meaning that they can charge what they want to. I also had an attorney charge 33%. It was the best money spent on my part. Did I get everything that I wanted from going to court - NO, did I get medical treatment on my shoulders - YES - by my health insurance myself. Which I am still doing today. That hasn't changed at all. Even now because of the way the final judgment was written, even my back is covered after 3 yrs of no treatment. Which means that this month it is now covered by my health insurance as well - so no need to mess with WC at all period. But remember each health insurance policy is different as well.

In the state of Iowa - medical is covered for life - but like other states you still have to go back to court to get the medical treatment needed or to get them to pay for the medical treatments that you have paid for out of pocket in some cases. Just depends on the insurance company and how they handle things. Some are good and say you have to attend an appointment at least once a year and they keep the file open, others make you still work for the treatment that you need.

The medical prescription cards I got - were never good when I got them, so to me it was a waste of the paper they were printed on, but they had to print them out to show that they sent them out. Even though I couldn't use them. So that's something you also have to keep on top of at all times.

But in the end it's your body, your injury case and you can't go this alone in the courts. No way. The companies will use some big hitters against you, and you will be lost in the maze of the leagaleeze that it will take. Not to mention in some cases the judges (commissioners) want you to provide them with a draft of what a settlement agreement will be, or final order will be. will you be able to do that?

Do some renegotiation on the expenses part of the bill. You already have the majority of your own medical records and once your represented then by law the IC has to send any doctor reports to your attorney as well. Now there will still be a discovery period where they can get other data like from NCM, etc. What becomes expensive is if there is a deposition from my understanding. Yet my attorney and the IC never did a deposition at all. So it's not something that is always done. A lot of my expenses were cut done just because I did do all the gathering of medical records myself over my attorney gathering them and in most cases that was just getting a form off their website and mailing it in certified to them and then mailing them all together to my attorney once I had a bunch of records. (also I could make copies for myself at the same time).
