As y'all know, I was to go and talk to the OIEC on Monday. What a laff that turned out to be. What they wanted to do was send me to a designated Dr... and because I had no medical records to back up my claim that I have an occupational disease, he would probably go against me. So that leaves me with no Dr's to see here in town, and will have to travel to Dallas when my new attorney gets my papers retaining her as counsel. She has only been practicing since 2000 but only does workers comp claims. The following is an exerpt of the letter she sent me that made me decide to retain her.

"my firm is dedicated to handling workers' compensation claims. I can help you with everything from your medical treatment to your weekly benefit checks. It is important that you find someone to help you with your claim, even if you do not choose me to represent you. Remember, the insurance carrier is not there to look out for your best interests:their client is your employer. (where have we all heard that.)

With my assistance, we will fight to get lifetime medical benefits for your entire work related injury, and not for what the insurance carrier believes your injury is limited to. The insurance carrier may attempt to limit the injury, and you may never know this until it's to late. They are not here to educate you on your claim, nor tell you how to help yourself. As your attorney, I will oversee all aspects of your claim, so that you can concentrate on getting your medical treatment and recovering.

This can be a very stressful time. You do not need to worry about things like: whether you are being paid the correct amount, if you have to see the insurance carrier's doctor, the constant denial of medical treatment, or worse, your benefits being stopped! I hope that you give me the opportunity to help you. Together we can get through the worker's compensation system and make sure that you receive everything that you are entitled to under the law."

How many times have we all said this to one another. And here I have an attorney that is putting it in black and white. I think that once again, I have lucked out and found just the attorney that I need to get things done on my claim. Although I had hoped that it wouldn't come to this point, I am not going to wait and hope that someone, somewhere will change their minds so that I can get treatment.

And although I am going to have to travel all the way to Dallas to get the medical care I need, the attorney has Dr's that she works with already that will see me on a lein basis until we can/can't prove that this is a occuaptional disease caused in the line of my work.

I am sooo happy that you decided to get an attorney Smile she sounds great and the fact that she hasn't been practicing all that long may be in your favor...she is hungry to prove just how good she is!!! If I got a letter that great from an attorney I would make a poster out of it, frame it and hang it on my wall Smile
