Praying
I am praying that someone out there may be able to help me with this nightmare they call workers compensation. I am so tired. I want it to stop. This has been such a focus of my life for almost 2 years. I have spent hours on the internet and it seems nobody has this situation. God Bless the folks who have such serious illnesses and being dragged through this mess. It is just awful.
It seems so pointless for my self-insured employer to appeal my allowed claim since the beginning and then drop their appeal 2 days before their hearing. They have appealed 3 times and each time it is allowed. But I guess the law allows them to NOT pay wage loss or for medical care while they are appealling. So I have suffered and received no wage loss or medical care. I have had to rehabilitate myself at home best i could based on what I learned going to pt 4 times and try to duplicate it at home. Can someone please help me. I dont understand any of this. Thank you so very much. God Bless. |

Hi Cindy & Welcome,
WC is doing their famous 'starve you out' tactic, in hopes that you will simply give up and go away! YOU MUST hang in there and fight! If your injury happened at work....you are entitled to proper medical care, weekly TTD cks (if you are off work w/ MD statement). BUT.... I know nothing about self insured employer rules...so go to top of the site and click on "state info" and read up. Please post What state are you in, and what are your injuries/restrictions, so people on here with knowledge can answer you. Take care & try to keep calm, Lilly

Hello Lilly,
Thank you so much for responding to my post. Self insured employers have to follow all the laws of Labor and Industries and they are monitored by L&I. The difference is they have their own claims handlers and dispense funds themselves. My employer's attorney has appealed my claim since the beginning and my claim has been allowed by the state since the beginning. Now that they have dropped their appeal, they are asking me 2 questions if I have had any other care for my injury and if I will need any care in the future. I was off work with my doctors statement that was given to my employer. I only received PT for a few weeks till the PT clinic decided they couldnt see me any more because WC was not paying the bills they were submitting (since it was being appealled) and would only allow me to continue to come if I signed a paper I would be responsible for the bills. I could not afford 800 a week so I had to discontinue PT and sad thing I was improving. When I first started going I couldnt lift my leg off mat. My knee was injured but with the non-use of it because of the delay in medical care,,,my whole leg was very weak and affected. I had to crawl up the stairs at home. So because of their appealling I have not received any medical care since I quit the PT a year and half ago. I started working again 4 months ago in a different state. The last MD off work slip was turned into my employer a year and half ago stating I was to be off work till I could find a new bone doctor (since the one I was seeing and who worked for my employer had to go to rehab for addictions for 2 months!!! I just got a call one day before an appt. I needed to find a new doctor!!!) I could not find a dr. in my area who would take me because I was WC and my claim was being appealled. So for the last year and half I have had to do PT on my own at home doing what I learned at the PT clinic and it has been a slow process. I am not quite back to normal but I feel I am at the point I am done with this WC and very tired of it being a part of my life and I want it over. But..............I want to know if they owe me back wage loss from the time I was injured till I went back to work,,,,,,,,and if they are responsible for the past medical bills including the PT bill that got sent to collections. I would also like to see a letter written to the collections to remove bad marks off my credit. The main thing is I want them to have to pay for the year of wage loss before I returned to work. Especially since if they had simply paid for my medical care i could have gotten well and gone back to work. It is so wrong the law allows them to cease paying and denying you medical care for a year just because they are appealling an allowed claim. If i understand correctly they cannot appeal again now.
