Statute of limitations
Is there a statute of limitations for a pre-existing condition in MA?

In 1995 I was bumped in the face at work. I was glad not to have broken my nose but in fact it caused damage to the roots of my front teeth. I continued working as the problem was not immediately apparent, more just like a sore nose. A few weeks later it became clearer and I did receive reimbursement of medical fees for dental care under WC.

My dentist at that time was very conservative and wanted me to try to keep my own teeth as long as possible, saying every year counted, so gave me 4 composites/2 root canals instead of 4 crowns/4 root canals.

Now I no longer work for that company, it's 13 years later and I’m having a lot of trouble with my teeth due to the original accident. Apparently the trauma caused a chronic cyst that's been slowly infecting the bone (now know the reason I’ve had more than my fair share of headaches and sinus infections over the years!) and I need to have crowns and/or implants as the composites are worn and discolored and my teeth show signs of brittleness. All this will cost around $7,000+ not to mention it's very stressful, time consuming...and painful.

Of course I contacted my old company but they say their lawyers have advised them they're no longer responsible, the case is closed. Is there are any way I can seek to re-open the original claim -- if I never had that accident in the first place I certainly wouldn't be in this situation now...
