What could happen????
Say I was at MMI and saw an IME doctor. The IME doctor put me on 1 hand duty which my new employer could not honor so I lost that job. What if I am to go out and find a new job like none of this has happened???
Have been waiting on anything from work comp since the beginning of january and I honestly financially can't wait any more.

then you take the chance of it happening again and the new job wont honor it....but if you can get a new job that you can do and stay within your restrictions and they know about your wc claim then go for it your WC claim stays in force

Problem is jayne i can only work left handed. Hard to find a job only 1 hand. Would I have to tell prospective employer of restrictions????

Just to try and help you out, I was out of work on restrictions and my job did not have any work for me based on those restrictions, so I applied for Unemployment based on there being no work for me at my job and I got it, all 26 weeks of it. As long as you are receiving disability payments or WC is in the works for you, you are still considered an employee of your former job, however if they don't have any work for you based on your doctors restrictions you probably will qualify for UE. I was receiving UE and WC at the same time which really helped.

Well first of all if they put you at MMI and your employer did not have any work for you one handed and got rid of you, you should be collecting unemployment with no question.

I have recurring carpal tunnel/tendonitis and my old employer found work for me sitting behind a desk watching the waiting room patients to see how long they were sitting there ( monitor). Thank god i found another job. Now i am at MMI and still in alot of pain, but have a position now that i can stop whenever i have pain. It is a job i do not have to use my hands all the time.

I would think it would be very hard to find a job one handed and i if i were you, i would collect unemployment until you feel better. Good luck.

Yes, to be fair, you must disclose your disabilities to a new employer. After all...you don't want to start a new job and have to announce "I can't do this (because of this!)"

You do not have to disclose your disability on your application for employement under the federal ADA act. If, however, you are called for an interview, you "should" disclose your disability but be ready to sell yourself and give your perspective employer some accomodation suggestions that would enable you to do your job. One good program for hand disabled is the "dragon 9.5", a voice activated typing program that is 99% accurate.

You can not be discriminated against because of your disability. If you think you have been then contact the ADA to file a complaint. It is hard to prove though, but generally if you are called for an interview, the ER thinks you could be qualified.
