CA Permanent Sationary
I live in California
My doctor just told me that I'm permanent stationary from a work injury incurred in June. I left that job in October, which is when I filed for workman's comp. Long story short- I didn't file sooner because management didn't think I needed to and I trusted them.
Just my medical expenses have been covered- which I'm totally thankful for. However, I've filed for unemployment and I know I'm not allowed to double dip. My former employer is privately insured. What happens now that I'm permanent stationary?

your disability is rated and additional permanent impairment benefits are paid.

Thanks for your help- this seems very complicated. It sounds like a lot of people on these boards are struggling with their cases. I just wish I never got hurt. Now I will always have a bum shoulder because my manager didn't think an eroded walkway needed to be fixed.

workers comp is "no fault". under the law neither party has to prove the other side is to blame. that's why benefits are limited for both sides.

yes do it will get it fixed for the next person however if OSHA fines them OSHA keeps the fine it isnt passed to you

actually no. California has separate safety laws that are more strict then the federal regs.
You have to report them to CAL/OSHA

Thank you for the OSHA advice. As far as the money thing goes- I am concerned about it. But whatever is decided to be a fair compensation isn't going to make my injury feel better. I've always been fit and healthy and I'm feeling totally consumed by this right now. I've been a fitness instructor for 10 years and now I can hardly open a door and carry a water bottle at the same time.
