Sorry I havent been on for a very long time. this winter weather here in kansas has played its toll on me. but here is my question. ok back in december i went to a doc my wc attorney sent me to cause i said that i should not be at mmi cause the doc released me to go back to work in november. i got his doctors report and he said in his opinion i should not be at mmi for i need more ortho care on my left knee and now i need it on my right knee. he said i need my back looked at now cause of my gait pattern is way off.and that i should have my left knee in a brace. and i should not go anywhere alone for he is afraid i will fall. my question is my attorney is doing a 7 day demand letter to get me into another doc cause of this report if that doc agrees that i should not be at mmi cause of all of my problems will wc have to pay me all that back pay from when my wc stopped cause they said i was at mmi? iam kinda confused on this

predicting whether the third doctor's opinion will be sufficent to change your status is based on what kind of agreement your atty and the carrier make. If they agree ahead of time to let the third doctor make the determination then it also depends on whether the third doctor says the TTD is retroactive.

Sis, Thats petty close to what happened to me. I was released to go back to work and continued to have problems. My original injury was my left knee.

My attorney sent me for a IME and filed for a hearing. At the hearing my medical was reopened and TTD restarted. I had an overuse injury of my right knee due to my gait and not receiving medical treatment.

Now my back is involved due to my altered gait.

I believe it depends what the IME report reads and what the judge's decision is.
