i was wondering if anybody knew how much of a monetary difference does it make if you settle medical. also is the ic quick to settle medical or do you have to bring it up.

i don't think my injury is "that" serious. i have 2 disc herniations. disc bulging annular tears and disc protusions. i got injured 6/07 and i've had 10-20lb restrictions, and no bending,twisting etc. since 9/07 and my job hasn't honored them. 1171 riddle me this. i'm non union at my job i was only working 1 month before injury been out 8 months and my job hasn't fired me. they just say they don't have anything for me by being non union they lay us off and call us back as a group. basically saying when my group gets exhausted i'll be back to work. i was wondering why they haven't fired me. wc can't make them give me a job.

might be never really hired most big jobs have a 90 day policy where they can just not keep you on for no reason..

i was hired as a tpt(temporary part time) we had to sign contracts saying that we wasn't being hired full time and put into union until further notified. so its not the regular 90 day and you in there job. they hired us as a group of 12 and they lay us off as a group. we started 5/14/07. i was injured 6/13/07. my group was layed off 6/30/07 and haven't been back to work since. i've had restrictions since 9/22/07. when i went to job to post restrictions hr said even if they could work with restrictions my group was laid off and i couldn't return until group returned. last week when i called i was told the same thing. if the doctor released me back to full duty i still wouldn't have a job to go back to so i don't really matter. ime stopped my checks 1/22/08. there is no way i can find a job paying close to what my job was paying(18.44 +2.10 cola) with my background. 27yrs old. no diploma. no job experience and with my restrictions. thats why i'm ready to get this thing over with. my doctor told me she can't mmi me until i return to work. its been 8 months since injury. i really wish job would offer me a settlement for everything including medical.

Have they been paying your medical bills and prescriptions if you have any? Have you been paid any wage loss compensation, such as ttd or tpd? Have you instead been recieving unemployment?

they started paying me ttd in 6/07 and it continued until 9/07 when i got my restrictions and it turned to tpd and it stopped completely in 1/08 when the ime doctor said nothing was wrong with me. i didn't work long enough to draw unemployment and i'm assuming they still pay for meds and dr appts. thats why i was trying to see if i should lean on my lawyer to see if settlement is an option and also how much of a money difference does it make if i settle medical.

tpd =total permanant disiabilty? if so you have already got and spent your settlement one week at a time

i think might have mislead you. when i said ttd meant temporary total disability. which in new york is 400wk. then when i got my restrictions it wen to tpd. temporary partial disability. which is 360wk. after i took ime they stopped it completely. i go to court Wednesday and i don't know what to except. i want to ask my lawyer about settling but i doubt if they will because its only been 8 months and the ime i took in January said i'm fine.
