Be very careful to stay within restrictions. If you reinjure yourself, the old company may say it's not their responsibility anymore because it's a new injury. The new company may say, it's not their responsibility because you just aggravated the old injury. Now you have both companies fighting about who will pay and that delays your treatment. Also, if you have restrictions and don't tell the new employer and they find out, they could feel that you misrepresented yourself when they hired you and terminate you,

doctors note say i cant work until i complete my therapy and my work called and told me "if i dont show up for work, we will terminate u"

It's when your Dr. says that there is nothing else medically that he can do to help you get better. Basically, what ever your restrictions are at that time, your Dr. is saying that is how it will be from that point on.

If your employment is covered under FMLA law then you are entitled to 12 weeks of job protection; after that you don't have much. there are some states that may give some protection but most don't.

3333,Welcome, I also am here in Illinois, Check with your employer and see if you qualify for FMLA. It will protect your job for 12 weeks, That is a Federal Law, The others are giving good opinions, If your Dr takes you off work you should think of you first and formost and getting the medical treatmen you deserve.

If you change jobs at this time it could mean trouble. My opinion would be do not quit your job at this time. If your employer terminates you and you are placed at MMI, You can then collect unemployment and your employer and WC will still be responsable for your medical treatment and bills.



Your health and treatment for your back are the most important issue at this time. and stay within the restrictions your Dr has ordered for you, If you don;t and injure youself further it could be used against you. Good luck and keep us up to date .

If your doctor said you cannot work and puts that in writing on your workers comp form that is filled out every doctors visit, then there is nothing they can do. I was taken out of work for overuse injury for 7 months and had a note stateing i could not work. I did have FMLA and went past that and still had my job available when i returned for light duty. Every work place is different, but if the doctor put that in writing and you gave that to HR then they should pass that along to your adjuster and then they would be making weekly payments to you.

carpal tunnel recurrence/ neuropathy / RSD.

thx for the advice guys. ill be goin to therapy for about 4 weeks and hopey fully i get cleared.

one other thing. can my work call the doctor and ask them if i can work under restrictions that are a few weeks old? i went to the company doctor and he first gave me some restrictions i stopped goin to that doctor and now goin to another one and he gave me a note sayin i cant work and now the company wants me to work so they called the doctor to c if i can work under some old restrictions. havent heard from them yet. but can they do that?

alright guys thx for the help but its gonna be a while until i get fixed and ready. i received a letter sayin ive been laid off work until further notice. now i keep hearing from some relative that i cant get laid off because im an injured worker. so my ? is that. can i get laid off work if im injured? would my payments still be covered? will i still get payed?

ps sick and tired of being injured and goin back and forth from work (an hr away) to my house and to the therapy (30min away) take a chunk out of my day.
