Where Worker's Comp claim should be filed
Hello, I was injured in 1 state and the company filed the claim in the state where the temporary office was located. Also on top of that they put down the wrong date of injury and how it happened. Can any one help me get this on the roll? I guess what I am asking is does anyone know for sure if the W/C claim needs to be filed in the state of injury or in the state where the office is located? What ever the case can anyone tell me how to file a claim in Colorado and get this case moving without getting a laywer involved? Thanking you all in advance Husker.73

and bubba you gonna need a lawyer.......if its screwed up that bad and you need medical treatment can you give more details?

generally jurisdiction is limited to the state where the injury occurred or the state where the injured resides. You can contact your work comp carrier directly and let them know which jurisdiction you want.
or you can file directly with the state comp board in the state you select.

Husker, My past experience, I lived in VA the co I worked for was based in MD But the accident occured in DC. After alot of buck passing 1171 is probably right.

Usually, state of injury, then state of residence. And sometimes the waters can be muddied even further. I you live in state A and were hired for a job that involves travel but the company is located in state B then you need to get an attorney that can advise you where it would be most advantageous to file.

If the company won't give you any help you can go directly to your state WC Board and file directly with them....
