Position Terminated while on WC..Help
In Alaska, had L4/L5 microdisectomy 12/2006 due to injury at work as a Phlebotomist/Floater. I was off work till April 4, 2007. On June 11,2007 ended up in the ER, had MRI, Showed more problems, Drs took me off work completely to have in total 3 Epidural Procedures, Physical Therapy everyday and then a 6 week Work Hardening program 11/01/2007 to 12/17/2007. On 11/20/2007 I recieved a letter from my employer that the postion I carried since 09/17/1999 was being terminated because I didnt have no more FMLA leave? anyone been through this before?

Me too, I was with them for 10 years and then the position was gone. I was released to work with restrictions, but they said I needed to be 100% and then they sent me a letter. I am afraid it happens more than people are aware of, until it happens to them.

Good luck and keep us updated with your next step.

I guess thats corporation for you. Well, all I know the State of AK UI sent me a questionaire, the questions pertained to " Why I Did You Quit ", I wrote up a letter to the state, gave them my WC #, sent them the letter my employer sent to me and told them I couldnt answer the questions because I didnt quit, I had no choice so there for they werent applicable to me. So im waiting to see their response. I know huh, work at a job for almost 10 yrs, no kiss, no call and no hug good bye.......thats corporate for yaSmile

I do not know about alaska, but here in NH they should of found you alternative light duty. When i was injured as a phlebotomist, they had me doing paperwork one handed for 2 months, which only made me worse. it caused me to get frozen shoulder.

I then went back to work after being off 2 months, and they made a job for me being a waiting room monitor. I am surprised that they did not have to find some sort of light duty work for you as there is so much work you could of done sitting down/doing paperwork etc.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%

I think everyone knows my WC injury happened in Alaska. Your former employer is absolutely under NO obligation to find you light duty employment. Very unfortunate but true. After your FMLA leave is up they can give you the ax..... If you need any help with Alaska WC stuff let me know. Even though I have an attorney I find that I still have to do almost all of the paperwork. So I'm real familiar with it....

Hi MrzParker,

I'm so sorry you have lost your job. It is an emotional "let down & great disappointment" to realise that your work didn't value you, as you may have valued them...or thought they valued you. Most of us here have been through the same thing. Keep your chin up, as you have a fabulous chance (being in the medical field) to land another job easily after you are MMI.
Take care, & Welcome to the forum! LillySmile

Injured worker, & tired of it all! I'm too old for games!!

A careless word may kindle strife, a cruel word may wreck a life, a timely word may level stress, and a loving word may heal and bless!

RE: Position Terminated while on WC..Help
I have been searching for the ak laws regarding FMLA/WC. Reason being is when i went to file for UI. I recieved a questionaire with questions asking me why I quit my job? Thats what got me thinking, I know how this employer works. I called the Employers HR office, requested the information they based their decision on, and to submit it to me so I can be prepared for my meeting. I have yet to recieve it. My motto, right now i have nothing but time and patience. If theres one thing ive learned while working in the medical field is Documentation! If my employer was in the right, then ill accept that. But until then im gonna get the information i need to verify it. Pray for me you all. Ill keep you posted. I have a meeting with a state public advocacy group that looked into my information, contacted me right away and I meet with them 02/07/2008.
