as i stated before the job sent me to take an ime last month and of course he said i was in the best shape of my life. i had a hearing 2wks ago but was sent before a judge for next week because 2 parties couldn't agree. based on the ime report my job has now stopped my wc checks. i have restrictions since sept.07 and my job has no intentions on bringing me back to work with or without restrictions. i go to the dr and pt which is the same people and thats in vain. all dr does is write scripts and pt just asks pain level and while i do exercises they be lollagagging. my question is it kosher for me to tell my attorney that i want to settle because whats the sense of dragging this out and i have no job to go back to. i feel like the quicker i get this over with the quicker i can take back control of my life. i know that you have to be at mmi to settle, so can i tell my dr to put me there because i'm done. i don't want anything to do with my job or wc. i want to settle everything including medical. i know they say don't settle medical unless you don't need it but i figure with no job i can get back on medicaid. i was wondering does a quick settlement affect anything and does settling medical makes a monetary difference in your case. i really need some advice on this my next hearing is on the 27th of this month and i want to know what to tell my attorney.

Not really, they don't have to settle if they don't wish too. For you would need a rating. And if you tell your Doctor to just put you at MMI, your Doctor will have to state you refuse anymore medical Treatment. it just doesn't work as easy as just saying you wish to settle out.

Bad Boy you are wrong anytime you cannot deal with WC anymore you have the option of giving up and getting out however they WILL stick you with refusel of medical treatment or some such nonsence and you will get nothing not one thin dime plus no job and no insurance coverage...your best bet is to talk to your lawyer tell him/her where you are at and leave it to him/her......I was there last year when I told my lawyer I would have no more fusions ever I was done with WC and they could kiss my ....well you know....My lawyer worked it out I didnt get the fusions and I got a nice settlement but it took at least 6 months of talks between them and us..... their docs said I was fine the court docs wanted to do more surgery.......so you may just have to wait and see

I thought that was what I was saying? Yes, you can Opt out anytime you wish. Will a settlement be there if one does? Most not that I know of.

Well i know when put at MMI they will have to set you up for a PIR rating, and like me, you could get a good rating that would make the ic want to have the lawyer to a IME and try to find a way to make it look as if it was something that was present before your injury.

I was put at MMI in Oct. and had my PIR rating in Dec. and got a good rating to which now my ic is getting their lawyer to set up the IME and i have not heard a date yet. It is not a quick process as it seems, as it can linger on and on just to make the ic save a few bucks and put more misery on the patient.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%
