settlement - question
Well I been getting the feeling by talking to alot of fellow workers who have called to check on my current condition that my truck driving days are over. I told my workmens comp lady I wanted to know a couple days ago and once again she tried to be sweet and walk around the question . Im guessing because of my brain injury she doesnt want to upset me.
Last night I dug throught pages of rules on the department of transpertation site and I am sure now Ill never drive again because of brain surgery per the rules I found. My basic question is how will this affect my settlement being I have lost whats considered a skilled labor career? Ive been told by the owner of the company no matter what I have a job . |

The job your companies owner is promising you, may be a lower paying job . The difference between what you used to earn and what you are able to earn post-injury should be considered.

I don't know how this will affect settlement. I just wanted to tell you that I am sorry you won't be able to drive a truck again. I know it really meant a lot to you and I am so sorry that your injury has caused another loss. It sounds like the owner of the company you work for is a great guy. If you had to be injured working, it sounds like it is a good thing that you were injured working for him. I wish the best for you!

Many truckers on here have lost their jobs....My honey included yet I would take his driving over many who I see still with their CDL......If your company is gonna keep you on consider yourself very lucky.....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

If you have lost your occupation, tell the judge. you should be able to receive some type of vocational rehabilitation, Now you can start a new career in something you can do. It is unfortunate you cant do what you want, but you will have other avenues to apply yourself to. |

My Driving Days are Over also, and I agree with You Jayne, I sometimes want to Stop a Trucker, and take over the Truck, they are so Dangerous! Too many Truck Driving Schools sucking Money out of Students, and sending them out too Green!! You can't learn to Handle 70,000lbs going down a Hill with Heating up Brakes at 70mph. in a Book!! I Truly Believe that's why there are soo many Wrecks over these last Few Years, and a lot of them being Very Deadly! Too many Green Drivers, and too little Common Sense!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

So if they put me hourly (which im currently not) do they divide my current average into a 40 hour week to get a hourly pay rate? Ive been told but some folks I will still get the same pay ..is that true???

[/qI am like you , I was told twice that I will never drive a truck again you need to file for retraining . I reall hurts me that I willnot get to do the career that I have done for 22 years . |

I'm very sorry you have to give up your driving careers....it is sad to have to let go of something you love to do, are accustomed to doing, and most likely did very well. Muttely, Don't give up hope yet! It ain't over, til it's over! Prayers for both, Lilly Injured worker, & tired of it all! I'm too old for games!! A careless word may kindle strife, a cruel word may wreck a life, a timely word may level stress, and a loving word may heal and bless! |

I am in the same situation and it painfully upsets me everyday. Luckily i found another career while i was on light duty within my restrictions and jumped at the opportunity. Acutally it paid me almost 7 dollars more an hour and i am already up for a raise as the company in Jan. of every year does raises. So, sometimes it is for the best.
So, just saying that, i am saddened everyday for a career i loved, and i cry everytime i think of it, but at least i can say i am thankful that i CAN work ulike alot on here that cannot. I can truely feel your pain and the other people on the forum's pain because of losing their careers and possibly never working again. I wish you luck, and i would seriously start thinking about what you might want to do the rest of your years of working. You may be put into voc. rehab to find a career once you are able to work again if you are not already. Good luck. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent.
