TERMINATED-wait 'til you here why
At my last MD appt., the doctor did not take me off work but he effectively made it happen by placing so many restrictions on me that it was not possible for me to do any part of my job within those restrictions.
I promptly returned to my place of employment after the appt to provide my administrator and the HR dept with copies of my return to work sheet; the doctor's office had already faxed HR a copy as well. My administrator's reaction was to 1) throw the paper at me while 2) yelling that "there's nothing you can do with those restrictions" and 3) continue to yell stating "I'm going to hire another nurse; you can leave and NEVER come back"...........I waited a few minutes and then approached her again stating that if there was anything that needed doing that I could do within my restrictions I was willing; she told me to leave because my restrictions were "impossible to work with" I contacted my administrator on Monday and did not bring up the reaction she had-I just asked her if anything had changed; if there was any way she could accomodate my restrictions so I could work either doing my regular job or doing paperwork only, etc. She was very cool and aloof and stated that "No, I don't have anything here you could do that would allow you to stay within your restrictions, so you can't workfor me" I told her I was scheduled to see the doctor again on Friday of this week and would let her know what the result was and her reply was "whatever..........good luck" Today I rec'd my "pink" slip in the mail------I was terminated with the reason for termination listed as "unable to meet physical requirements of position" HUH?! Am I nuts or is this the height of irony? And yes, before anyone takes the time to type it, I am interviewing attorneys........ Just for kicks a few hours after the scene where my administrator threw a fit when I brought my paper from the doctor I was admitted to the ER with a MI (heart attack) and underwent an emergency heart cath...................... what a mess.................looks like I'm in for it now..............any thoughts? any suggestions? I did contact my adjustor to notify of my status and was told, literally, when the check would be in the mail ![]() REALLY DOWN in LOUISIANA[/i][/b] nurse83 "After all, tomorrow is another day." Nurse How long has this been going on with injury ?
Does your state have anything about being termed for filing a w/c claim? |

Tweety, i haven't been able to find anything official about being termed and w/c.............. if you're asking how long since i was injured--that is about 2 mos ago and i was not taken off work. I had been working with restrictions that were increased at each MD visit (w/c MD)............. I called in a couple of days before my last MD appt due to extreme pain, being basically immobilized. When I saw the MD after that he put sooooooooooo many restrictions on me, I figured I'd be told that there was nothing I could do with the restrictions. nurse83 "After all, tomorrow is another day." I am so sorry you have to go through this. As if you didnt have enough to deal with that heart attack must have really been the scariest thing ever. I hope you feel better soon. It amazes me that a place that is supposed to "help" people is incapable of treating the people who do the helping with some respect and dignity.
Ive been going through misery alongside my husband dealing with the hospital he works for. They are falling over themselves trying to make life so miserable for my husband that he will resign-but he isnt giving them the satisfaction. It wont be long before they end up terminating him anyway-and this from a back injury that he was out 3 months for, and has been back to work for almost 2. I hope you are able to ultimately nail these people-its pathetic how administrators seem to stop being human when unforeseen circumstances put a crimp in their scheduling. |

I am from Kansas and I remember my attorney telling me they can let you go if you can't do the job.
I believe some state don't allow that previous to MMI and protect the IW. Good Luck! |

Nurse, I Wish I had some words of wisdom for You right now, but the Only thing I can think of is ti Make Sure the Attorney You Hire has all of the Facts, and How You were Treated by this Supervisor. Is there Someone Higher Up on the Ladder above Her that You could Speak to? It May not get You Your Job Back, but it Surely May make You feel better to get this Persons Behavior Out in the Open! Please don't let Your self get too Stressed and give Your Heart Time to Mend, and know my Prayers will go out for You at 9:00 along with the Others!! Be Well!

Nurse,
This is so wrong, how they treated you. Did they ever file FMLA papers for you? That is supposed to protect your job for 12 weeks. I would also ask whichever attorney you choose to use, if you should file a complaint with the EEOC(Ithink thats the initials). Good luck with everything, and try to keep your stress and pain levels down, you don't need another heart attack. Take care. Vickie |

What a bunch of idiots and pathic superiors. I am so sorry you are being subjected to such treatment! You health is on the fragile side right now (from the H.A.) that you certainly don't need the added stress. As if YOU can HELP IT that you had an MI along with your injuries. Select a " no nonsense lawyer" with a real attitude....and go after their azzes if possible! IMO, your work may have made some bad desisions that are illegal. Morning nurse ....... ...... I am appalled as usual at what employers and IC's do to an IW. Please, please take care of yourself and heal from the HA.Vickie is right. If you have worked enough hours, days, I'm not sure which it has to be you are entitled to being put on FMLA. What that does is protects for job and benefits for 12 weeks. In my state as is most an employer cannot fire you as punishment for filing a WC claim BUT there is no time limit that IF you cannot do your job , you can be fired. My employer leaves our jobs open for one year, at that point they don't fire the employee but fill the job with someone else and then tell the IW when they can work again to call and see if something is open. This is the legal way to fire an employee while they're injured. Mine tells the IW that it's a hardship on the dept to have an employee out for such a long period of time. Here is some information on the FMLA. When comp turned down my husbands claim, the hospital he works at automatically used up his sick time for the first week, then filled out the fmla paperwork. Check out this link to see if the fmla pertains to you.
