monster Wrote:Oh geez, you poor thing!  I don't have the answers you are seeking, but everyone (besides me) is giving you great info.  I really am sorry you have gone through this.  Please keep fighting for what you deserve, I can't believe how horribly you were treated by your boss.  Most people treat their animals better than that.  I really am sorry and hope you get all the back benefits that it sounds like you are due.

Best wishes,
monster

RE: mediation
Rawhide you will soon find as you probably know by now, nothing when it comes to w/c is cut and dry. What's a shame to say is the problems you are having are more the norm than a rarity. I've been deemed totally disabled by the Fed. Govt. based on my injury only with no underlying factors and my case is going on it's third year with no end in sight! Hang in there, sooner or later the sun will shine again!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

In the end it doesn't matter how many years were in your life but how much life was in your years.

stiffnecked Wrote:Start educating yourself. If you had all those levels fused as a result of the work injuries that 50% sounds pretty low. I'm not sure if Missouri uses the AMA guides or not. You need to find your own doctor to do the rating. Relying on the one the IC sent you to isn't going to protect your interests. Below is a good link for that resource.

The companies bankruptcy has no bearing on a workers compensation case, unless the employer is self insured. Even in that case the State has special funds setup to protect workers on that case.

RE: mediation
I went to a mediation about a month ago. Mine is continued. Mine was a brief meeting with all in one room, me, my att, their att and the mediator which is for neither side. Each side makes an opening statement then off to separate rooms where the mediator will go back and forth as each side makes offers. They will try and settle at this time. Mine due to an error in a report had to be continued to get error fixed. I was really nervous about going to mine but nothing to be nervous about. Found errors in their paperwork that I had never seen and makes a difference so keep your eyes open and ears and ask to look at papers to see if they match yours.
Good luck to you and hope you get farther than I did
