Please help Me!
I was injured in my office 3 weeks ago. I injured my right shoulder ( I am right handed). I go see the doctor on my day off (a Thursday)so my husband can drive me. I am suppose to start rehab therapy on Monday and I was told that I could go and it would be without pay unless I wanted to use my vacation time. Is this how it is?? I thought sinc I was injured on the job and on company property I would be paid for the time I am going to therapy. If I am not being paid why do I have to go back to work after therapy or lose my job? What is right here? Can anyone help me?

Hi NJM and welcome to our family. Sorry you were injured. Did you file a WC claim ??? If not you need to in order to get medical and possibly paid for time lost. Don't let your employer sway you the wrong way. If you were injured at work you have the right to file a WC claim. Please let us know.

RE: Please help Me!
most states do not include medical leave time as part of work comp coverage.
some states do.
without knowing yours I can't be sure.
most employers terminate unrestricted employees who don't show up for work; it's not an unusual policy.
If you have medical work restrictions that's another matter.

I live in Texas. Which is a world all of its own. I do have restrictions that I am not suppose to use my right arm. I am a CSR and I talk on the phone and keyboard all day long. I can not take my pain meds while at work as they make me sleepy. I am at loose ends here.

RE: Please help Me!
If the dr said "do not use the right arm" don't use it. I know that sounds simple. The fact is that if you can not do your job due to the restriction placed on you by the dr.. You need to let the dr. know. You also must let your employer know of the restrictions. That way they can see if they can accomidate the restrictions.

As far as getting paid for dr. visits and pt.. I can not answere that one. But you can call the adjuster that is handling your claim and ask. You can also call the office of injured workers and ask them. They use to be known as twcc.

RE: Please help Me!
Thank You. They know the restrictions and they say they are accomdating me because they moved the mouse to the left side for me to use. I am right handed. Thank You all for your answers.

RE: Please help Me!
Hi there NJM and welcome. I'm from Texas too - Dallas. When I was first injured and still working the company paid me for the time I was at work and when I clocked out to go to the doc then the IC picked up the rest. I did not have to use my sick/vacation pay unless I took a day off.

In Texas you can use an Ombudsmen to ask questions if you do not have an attorney:

http://www.oiec.state.tx.us/topics/ombudsman.html

Also, at the top of this site look for State info and you can research per Texas. This is the link for Texas:

If you have any questions please feel free to PM me.

Hope this has helped you somewhat.

Deb

RE: Please help Me!
Sorry, I didn't read your original post correctly. I somehow missed that you said you were working. My post made sense if you weren't.
In my state you would not be paid for going to a Dr. or PT.
