Sad PPD or SLU?
Iam in new york and have a scheduled slu appointment, I dont have any idea what my rating will be, however Ive been out for 29 weeks on ttd, if for some reason my slu rating is 10% , the way i see it it would be 10% of 312 weeks, approximatly 31 weeks, that is for an arm hear in new york, my aww is 625.00 , so this means that I would get nothing once they subtract the ttd? Am i correct in thinking this way? I hope my rating is much higher ,I just have know way of telling. Now since i have chosen not to have surgery will this leave me at ppd? What exactly do i need my dr. to do to at least try to recoup some money for this injury that i will have to live with the rest of my life? Its getting down to crunch time and I am getting real nervous i have hearing in 2 weeks to establish my injury and then its off to see there ime. Does anyone know how new york comp works. do they really subtract your ttd?

TTD and PPD are 2 different funds..

TTD= temporary total disability
PPD= permanant partial disability

Other than that I am not sure how to answer your question. In Kansas (where I am) each injured part is covered for a certain amount of time. If you injure a part it should be healed in such and such amount of time. If the amount of time the injury is covered is say 210 weeks and you are out for 50 weeks that leaves you with 160 weeks. In Kansas they take off the first 15 weeks which would put that person back up to 175 weeks. Then you multiply the weeks (175) by the amount of pay you got on ppd say $250 and then multiply that by the percentage, say 10%.

175x250x.10=$4,375

Now, I don't know if that's how it works in NY. I'm not very good at checking out other states web site, but maybe if you read up on NY, this will help make it clear. I hope I haven't muddied the waters any more than they already were.

Has your doctor put you at MMI? Cause i know that if you may still need surgery, i do not know how he can put you at MMI yet. If there is any more procedures that may be able to help you, then i do not think they put you at MMI till you reach the medical standpoint. MMI is when there is no other help they can offer you, and you will have to live with your injuries. Just curious how you are comming up with percentage right now.

carpal tunnel recurrence/ neuropathy / RSD.

If I recall correctly, and having had a friend in New York who went through a WC case, the state of New York will not even consider settling a case until one year after the worker has been declared MMI. I tried to find this in the state guide, but man is it confusing.

You may want to call the Advocate for injured workers in New York with some of your questions:
