I think an information packet would help a lot of injured workers. I know that when I was hurt, I had no idea of my rights and my employer didn't offer me any information. I called the state and they said they couldn't help me unless I had specific questions and the Kansas website is almost worthless. If the employer or the ic would let us know the steps and what to expect things might would go better for the iw.

For instance , my supervisor swore under oathe that he knew my injuries didn't really happen on the date I said they did. He was away on business so how was he possibly able to answer this question???

Jaspell, let me tell you why I for one filed a w/c claim against my company,I got hurt lifting 45 pound parts on a machine in a factory, turned while moving one of these parts and felt a popping noise in my neck.I felt bad for a couple of days, then decided to tell my superviser,I told him I felt like I needed to get it checked out by a doctor, he totally ignored me, just sat there looking at me, and then got up and walked away.So I then went up to the office and told our human resource guy. He told me to take ibupropin for a few days, , A week later I was still working and went back to see him.He said he was going on vacation and could I wait another week,I told him I would be on vacation the following week and I was willing to go to the doctor on my own time if he would set it up for me,he said he would call, I called him twice that week, never returned my call. When I went back to work his boss called me in the office and asked me if I had been to the doctor yet. I said no, they sent me that day I got injured june 14th, finally went to the doctor July 6th, they took me off work, went to several doctors over a 11 month time span, got released on mmi , permanent light duty, they could have given me another job that was easier, because I had done a inventory job before, not much lifting but instead I got terminated I had 23 years total with this company,sorry this is so long,When you get treated like crap this is why I filed a claim against my company.Thanks for your opinion though,Halftrak

Hay I feel your pain, I to was injured on the job in 2006
I was on SSDI and tried going back to work and the 2nd day on the job I was injured and my boss left for the day so when I saw him again I told him what happened. Being threw a WC injury back in the late 80's I told myself that I would never go threw the B.S again. Anyway, my back was killing me and I tried working and it came to a point to where I needed medical help so I went to the Company Dr. Now I find out that the Company Dr and one of my Surgens are in this together as this Dr will not operate to repair my torn Disc's which are causing me disability and I have No where to trun. I can't begin to explain what I went threw for the next 16 months, I lost my job, went threw 3 operations which involved a series of spinal cord pain stimulators and adjustments , EMG's , drugs and a lot of drugs, many visits to several Dr's , even lost one of my Dr's due to a medical bill that I could not pay due to lack of funds and this was a blow that I can only say that I was not given a common reach around if you get my driff, I am now back on SSDI. I have not received any benefits since my injury - NO PAY CHECK - NO INSURANCE - COMPANY REFUSES TO PAY A DIME. So now I sit at home becomming more depressed. As a former law enforcement officer and investigator I know to well the ins and outs of what insurance companies will do to fight any claims and what they will do to scam you into any setlement and take my advise BE VERY CARE FULL WHAT YOU DO- CLOSE THE SHOP DOOR WHEN YOU ARE IN THERE. PICTURES SAY A THOUSAND WORDS - Get my drift. Any way I hired an attorney who I thought was the best to help me get my bill's and a large settlement , this again was 16 months ago. No I am in deep as he just sits on his ass . Be carefull how you hire, investigate the law firms company history, its win and loss record, the experience of the attorney , his he - she a fighter or a suck ass, . Bug the heel out of the attorney and don't let them tell you some bull crap. Remember the attorney works for you not the other way around. I live in Illinois and I know the laws differ from state to state.
Stay the course and remember you are the injured and you have rights and maybe we the injured should gather all together and march the streets of our state capital and make our voices heard so we can chanhe the laws as our states have failed us.I wonder what it would be like if one of us would sit on the chair of our states workmans comp adm and insure our rights are given back to us and help the injured, disabled.[/u][/color][/size][/font]
