Hi Down but not out....First, welcome to the board. I have seen your name many times as being here and I was hoping you would decide to join us. As to you question, I believe it would depend upon the kind of injury you have? If it is ortho related and your PM doc's specialty is family medicine then I don't believe that his rating will hold up in court against an orthopods rating. Just a thought. How did you recieve this rating? Was their a FCE to support the rating numbers or was it just by your doctor doing the assessment? This could make a difference also.

Thanks everyone , my PM Dr. does treat ortho type injuries and the I/C gave auth. to rate me also . But now I find out from my lawyer that the comm. isn't going to allow it . I just want out now but I don't want to keep on getting screwed at every turn I make , and that's the way it's been for yrs. now . The way I see it is my PM dr. rated me by AMA standards and they don't like it so now I go to their dr. and he gives me a lower rating . Ok I then thought they would have to split the differance and I'd be given a rating in the middle but lawyer says no they aren't going to do that . My question is can they make the rules as they go or is this like a reg. court where if they set presedense (sp) already then they have to follow it by the book ? Thanks everyone again

if the courts isn't going to allow it - then why can't your attorney get authorization again for an ortho to give you a rating?

how many times can 1 person get rated ? I thought if my dr. rated me and then I/c dr. rated me and if it's lower then the first rating then the comm. split the differance .

RE: Rating
Actually at this point, it is not an even split. Your rating would beween two qualified doctors but maybe just not evenly split.
