hi 1171,

first, i'd like to say this is a terrific website

next, monster told me u might be able to answer a question or direct me to a resource that could.

i live in louisiana; am injured (12/07) working with modifications; my problem---i'm losing work time each week for doctor visits, therapy, diagnostic testing; my company makes me schedule all this before or after my time at work. i'm losing at least 12 hrs a week.

my questions: am i entitled to compensation for this time, either from my employer or w/c? if so, how do i go about securing the compensation?

p.s. ANYONE else out therewho is knowledgable on this topic PLEASE feel free to post or PM me.

i did sleep in a bit today.

time off to attend medical appointments even for a work comp injury is considered leave time and not "disability". Only about half the states have any provision under their work comp law to cover some of this leave time --- - most with various restrictions.
I don't believe Louisana does provide leave time but they have a fairly responsive work comp agency and if you contact them they may explain if there are any exceptions.

most workers assume worker's comp is either like their health insurance or their auto insurance.
big mistake.

workers comp is not insurance on the worker; it's insurance on the employer. They are the policyholder and pay all the premiums. It's their claim not the workers. that's why workers have little say in what happens.
It's also "no fault" which is much different then negligence law and civil suits: no big pay out and no extraneous payments for pain and suffering or "loss of consortium" etc.
No fault means BOTH FAULT e.g. the employer and the employee share the problems, difficulties, costs of the injury. It's not up to the employer alone to make up for the employee losses due to the injury. there are limited benefits for the worker and costly payments for the employer.
For the worker this means disability is capped with maximum rates; leave time is not covered; medical is tightly controlled and many treatements are restricted. for the employer the costs can be quite high and coverage is mandatory.

these work comp laws are set by each state's legislature. if you want to change them that's who you have to contact.

Wow---thanks for taking the time to school me, and any other "newbies" on that "why".........i appreciate it!

you're right--i never really thought about what w/c would or wouldn't do for me until i was injured.

everything the w/c doc is reluctantly ordering is taking FOREVER to be approved. i'm very concerned about this. i fear that these delays in diagnostic testing (MRI, EMG) which could give a more definitive picture of what's going on which in turn would allow the proper treatment to be prescribed may have serious reprecussions.

i also have other health issues which i am afraid my present condition, if not properly diagnosed and/or treated, will negatively impact.

but as they say, i guess i'm preaching to the choir!Big Grin

I live in NH and whenever i was working and had a doctors appt. that had to do with my injury i would put in the time i worked for my employer to pay, and then the other hours wc picked up for and sent me that in a check.

Different states do different things. I guess i was one of the lucky ones that got reimbursed for time i took off for doctors appts. and pt/ot.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%
