Bummer Knees I am so happy that it went well. THey sound like a great group of employers to be working for. Have you checked with HR, to find out what the policy is for unpaid leave? Most employers have a policy about length of time they allow for unpaid leave time.

fmla...is only for 12 weeks, and if they have not asked Bummer Knees to apply for fmla, it has already been used.

Yes...what happens or should happen is that when an employee is hurt at work some employers have the employee use up their fmla while they are out. However, based on the federal law, they must notify you in writing if they are doing this. In this case, Bummer Knees whether he was notified and used his fmla when he was first hurt or not would not qualify now. The reason is because the employee must work a minium of 1250 hours in the last 12 months to qualify for this leave. He has been out for 18 months. Fmla leave is not necessarily paid leave however, it is leave that says the employer has too give you a job back that is equalivant to what you had before your illness in terms of position and finances. I hope this helps.
