Question contract terminated after injury
I was employed in a contract situation by a hospital in South Dakota. I recieved a diagnosis of a fractured patella to my left leg and soft tissue damage to my right arm, which is still very painful to even use to turn a doorknob, the ER Dr. never xrayed my right arm on my visit to ER. Basically several days later the Hospital called my agency and cancelled my contract. They did not use my injury as a reason however made up false reasons stating that I was not performing my job, had left in the middle of my shift and had stated that I had a gun in my car...all which are false. Up to this time I never had a complaint by the employer on anything. I feel they made up these reasons to justify cancelling my contract which guarenteed me 48 hours a week for 13 weeks. Can they get away with doing this or do I have any recourse?

If the Accusations are False, and You can Prove them, Retain an Attorney and go at them with All that You Have!! If it's going to be tough to Dis-Prove their Claims, I'm not Sure what You would have other than Your w/c Claim for Your Injuries. While being Under Contract, did the Hospital File a w/c Claim, or did You have to do it through Your Co., being that You were Under Contract? I Surely Hope the Best for You, and have a Happy Holiday!!Wink

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

contact your union rep. they should help protect you from an illegal termination. when you are denied unemployment you can appeal as well.
If you can show it was retaliation for filing a comp claim you can win a discrimination complaint as well.
