Notice of Mediation
ok everyone, just wanting to now what i'm about to get into with this. it's set for June 14 so have some time to prepare i hope. here's what the letter says: Notice of Mediation the above parties are hereby notified that the above case is set for mediation as requested. At the mediation all parties are expected to know the issues,the facts,and the law applicable to their case4. They are also expected to have with them the written evidence (i.e., medical report(s) containing an opinion as to the nature and extent of permanent disability, causation, and/or additional treatment) upon which they intend to rely at the hearing. ALL PARTIES MUST HAVE SETTLMENT AUTHORITY OR IMMEDIATE ACCESS TO THE PERSON WITH AUTHORITY AT THE TIME OF MEDIATION. All parties shall appear promptly at the time and place specified below. any help from those who've been this far would sure help now. thanx.

Mediation is usually handled by a Judge (Here in Pa. anyway) with you and your attorney in one room and the i/c and their attorney in another. The Judge will hear your concerns and look over your evidence and do the same for the i/c. After that point, you will try to hash out a settlement with the Judge acting as a go between for both parties. The laws have recently changed in Pa. and a Mediation hearing is mandatory 60 days after a claim is filed for court to try and close cases quicker and saving trial time. This could work out very well for you if you are realistic about your settlement demands and the i/c is also. Best of Luck and let us know how it goes!!!

Good luck with your hearing!! I have a hearing set for tomorrow 9am. Attorney doesnt want me present, but wants me available via phone. Im not sure what my hearing notice looked like or what it said. Im having a hard time getting my attorney to send me things. Actually he hasnt sent me anything Ive asked for.

Good luck to both of you. I hope whatever is decided goes in your favor. I do believe that depending on your situation, you might want to make medical as part of your settlement. Just a thought.

Are you handling your own case or do you have an Attroney?got an attorney as soon as i got out of the doc's office the day of injury, wasn't even going to attempt this myself. i seen what my sister-in-law went through with her case and went straight to the best lawyer around because of it. lol all i wanted was to be fixed.....now, three years later, i'm hoping things are finally coming to a close. thanx for all the help and support from here and a few other good forums it's been a bit easier to go through. and thanx to a couple of sites that are so against an injured worker, i've also learned how they (IC peeps ) screw those of us who've been injured and have shown me they have nothing but contempt for the IW because they know they have a hundred others waiting to be put to work right where you left off. no sweet of their backs i guess. they have definitly given me a different outlook at how i view any employer from now on! again, thanx for all the info and support...god knows we need it, although i think he really don't care sometimes.

Rabid,
I never went to mediation for my injury, as the settlement was pretty cut and dried in Nevada. However, when I asked for Voc Rehab, it was initially denied. I ended up going to mediation for that. I sat in the waiting room of the court, while my attorney met in the hallway with the attorney for the IC (My employer and his attorney never showed up). We went back and forth for about 30 minutes and all was decided before we were even scheduled to go before the judge. Don't be surprised if this happens when you have your mediation. There are times when it is faster, as well as more profitable, for all involved to settle the issues before the actual scheduled hearing. This releives the judge of making the decision, and keeps the looser of the mediation from being able to appeal and keep the case running longer than it really should. hi rabid.........hubby went to mediation somewhere around the two year mark after being injured. no one could agree so it was continued and went before the judge for the last time almost 1 year later. he did win. mediation in his case was to see if both parties could agree but sadly couldn't. i wish you the best.
