Band together has a brilliant idea.
There is power in numbers. Worker's are wronged individually, and rarely are their stories heard by other injured worker's. If worker's communicate, using the power of the internet, then a pattern of insurer/agency wrong doing will certainly emerge. If wrong doing is shown to be a practice, then meaningful action can be taken on both
a state and federal level. If anyone who posts, identifies their home state , it would be helpful in determining where problems are most often occuring.
when a claim is denied or delayed to one person, it can be called a mistake or an isolated incident, but when a pattern of delaying or denying legitimate claims can be established, then legal action would be possible.

fight on if it keeps you going over 7 yrs I have been here.....NO ONE WHO CAN CHANGE THE LAWS GIVES A RATS.......... Because the system works for the majority......and that is the basis for this country the majority rules.....My congressman is a friend and he feels for me but he flat out showed me where it works for the majority.....and all the money is in their checkbooks to buy their rules......and when a work place is fined the IW doesnt get the fine OSHA does....we can be replaced as easy as opening the door......We have to fight within their rules to win....that means calling your congress men and women when they mess with you.....getting the very best lawyer you can.....and for goodness sake research and vote for the leadership that will help the worker not big business......be pro-active in your case and your life.....

Money talks not the majority It's money. A few years back a governor here
in Virginia refusesd to sign into law (can't remember the exact bill) a bill
that would help the injured worker because it would deter businesses from
coming into Virginia. It's all about money! But you know bad publicity really
talks. The ACLU should really jump onto this because they don't care who
gets hurt and they are free! Not to mention good! You know there are a lot
of injured workers that are now disabled and being disabled and what they
are doing is breaking the law. My son's caseworker has violated the HIPPA
law by sending him a copy of someone elses medical records. I know w/c
is suppose to be immune from HIPPA but sending a persons medical record
to another injured worker is way out the ballpark. Please people ban together. We're in Virginia and we need to get organized. A letter to the
editior of your paper will help. Just search the web for tips on how to write
one that will make the cut!

been there done that......contacted Oprah,maury,Nancy Grace contacted my congressman It works for the majority......so it will be left or made even worse.....the wc bill PASSED AFTER I CONTACTED my congressman was even worse......you must learn their rules,get your friends and family to buy long term disabilty tp protect them selves but make sure it is the kind that pays in addition to wc

Jayne's Points are Very Valid. I can Understand How wanting to Band Together seems like a Good idea, when the Steel Mills went down Here in Pa. in the Late 70's, Many Good and Hard Working Foreman, (Non-Union when in Management) My Father Included were Fired, many Very Close to Pension Time. They kept the Young Foreman fresh out of College, because they Paid them Peanuts Compared to what the Older Foreman Worked Hard to Earn. They Banded together and Sued United States Steel. Some were bought out by the Co. and left the Group, and in the Ultimate End, the Remaining Foreman lost their Suit. There were Approx. 40 Men and Women in this Suit, with One Lawyer to Represent them. For the Co. it's Very Easy to Buy ONE Lawyer, but Very Hard to Buy 40!! As Jayne said, Learn Your Rights and Protect them, have Friends and Relatives Buy Long Term Disability Policies, and Hire a Qualified W/C Certified Attorney. I know this is not True in Every Day Living, or to some maybe it is, but You Must Protect Your own Case, Fight Your Own fight, and Hope to Win! Everybody's Cases are so Different, We are all Dealing with Different Ins. Co.'s, and by Winning Our Separate Cases for different Reasons, We can change the Law. When an Injured Worker Wins because of a wrong by the i/c, it goes into Case Law, and can be Referred back to when needed to Help Win other Cases! So Winning Separately by Protecting and Knowing and Fighting Your Case is actually Banding Together, because Every Win sets a Precedent that can Helps Others later on!! One Win at a Time, by Fighting and not giving in Will change things, Maybe slowly, but nothing Good Ever Comes Quick or Easy!! Happy Holidays Everyone!!

When I think of banding together, I don't necessarily mean creating a group of people marching on the capitol. I think of sharing information.
Isolated wrong doings by i/c are explained away easily. For instance,
in gayle57's case, if I'm not mistaken,a surgery was cancelled. I also read of it happening to someone else. Jayne appeared well aware of this practice. I realize that terms of use probably won't allow the naming of the i/c involved on this particular site, but this is certainly not the only avenue to share info. First know you enemy. How many injured worker's go blindly to the slaughter believing their employer's.
insurer's and government will protect them. Let's identify which insurer's,which states, which doctors, which lawyers so that worker's can be better prepared to defend their rights. Winning sets precedents, but so does losing, and when the deck is stacked so that valid cases are lost, it's a problem. If a lawyer can be bought, I'd sure like to know who he is so I can avoid him.

Fair enough. I'm new to this site. I am not new to worker's comp. 11 years since injury. I wish that 11 years ago I was directed to a site that would have let me know what to expect. Now I've seen it all, read every case, learned the hard way everytime. I think there were
51.000 new cases in my state last year, and I can only find 3 members on this site who are identified as being from my state.
Who is the best lawyer in my state as rated by injured worker's?
Get a good lawyer is great advice, but I can tell you that the yellow pages isn't the way to go. So much more needs doing.

your right word of mouth is the best....I am from okla I had the best I was sent by my boss also a lawyer when I first got hurt.... his words to me...they are gonna do there best to screw you here is the best in the state and slipped me a piece of paper with my lawyers name on it.....you live in okla I will give you his name....you live in PA we got the best there also.. the best are also very busy so patience is best....many of us here have names of lawyers we use and will steer you when we can......but out of those 51.000 how many sailed right thru?In okla my congressman researched it and WC works for the majority the cases where one or two dr visits or a bit of PT will take care of the problem.....Its the rest of us that have to stand tall and fight it out......
