IME and lying caseworker
My son's neurosurgeon has asked for a fusion and says my son will
need more operations in the future. His caseworker sent a letter
to another physican stating that my son's dr recommended prolotherapy due to a back degeneration disease. This is a total
lie. An on-the-record hearing was scheduled and all parties have
to have their documents in by January 10th for the deputy commissioner to make a swift and final decision. This jerk lies
saying the primary dr (neurosurgeon) referred him to another dr
and that my son never responded. On top of everything the appointment is scheduled for February 26th after the hearing which
means the hearing will be cancelled and his lawyer will have to get
a "trial hearing". I researched this dr and he is on some boards for
health insurance companies determining whether the i/c is obligated
to pay the claim. What can be done? My son's lawyer seems
to be really dumb or is just "playing dumb"

If anyone can give any advice please do!

RE: IME and lying caseworker
call the docs office and see if he can get you in eariler but then the doc needs time for his report....do you have a copy of the docs report saying he needed surgery?maybe its time for you to talk to another lawyer just as a consult...Judges are not dumb have your Docs report and I bet you get a fav opinion then fire the NCM

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile
