Need Help
This is my first time under workers compensation and I live in Virginia. I have been out of work for 22 days. I understand that the you do not get paid for the first 7 days until you are out of work for 21 days.

Question 1: When do you get the check for the first 7 days after meeting the 21 day waiting period?

Question 2: Is it typical for your representative to call your Employer and ask them if they want to decline your worker's compensation benefits?

Question 3: If you have a operation on your elbow and once your doctor says you are 100% ready to go back to work is there anything else you are eligible for like scars from the surgery?

workmans comp does not pay for pain and suffering...your bloody lucky if they pay your WC checks,meds and doc bills....

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

usually checks are sent within 14 days.
It's the employers insurance policy. verifying injury and coverage as well as the details of the accident are common before making payments.
some states have additional benefits for cosmetic disfigurment

I live in Virginia too. My son is a victim of workmans comp. If you are not
physically hurt count your blessings. My son was hurt in June 2005 and
is till fighting workmans comp insurance company. He has lifetime medical
but so what? They approve nothing execept his medicne for pain which no
longer works. Yeah he gets paid each week but that doesn't compensate
that he is 27 years old and can not longer even drive his car or sit for any
real length of time. If your physcian says you can work then you have to
work and they will pay you nothing. This happened to my son. Luckily
he got a second and third opinion that favored him. However to this day
they are still fighting this. You need a good lawyer. I hear Jerry Luckheuss
is good (check the spelling) and Geofrey McDonald firm is good. Do not
go to Tom Schillings or Jenkins and Block. My son qualified for financial aid
at MCV and his doctor is Harold Young. He is about the best in the country
but he doesn't like lawyers. Before he even saw my son my son's attorney
had to write him a letter that Dr. Young would not be called on to testify.
There is no alternative to this system. No one is accountable. There are
no lawsuits available. Insurance companys RULE. And injured workers
pay. If you feel you can not go to work and you have lifetime medical. Try
to get a second opinion on your own. And a good attorney to reopen you
workmens comp case.
