I need help with MIR
I got hurt on the job over a year and a half ago. I have a disability rating, have gone to BRC(with no settlement), and I was suppose to go to court yesterday. The opposing lawyer has asked for MIR. I have nothing that qualifies for them to do this. They are trying to say that my first Dr. gave me a disability rating, he did not. I only say the man 3 times and it's been over a year ago. I called that Dr.'s office and they said he just recently was asked what disability rating he would give me. Now, I have not seen this Dr. in over a year, a went back to work on light duty for 8 weeks and have had another MRI where there was a shadow in my first one. Can they take this Dr.'s expert opinion after all this? I am in TN. Please if anyone has any help. I have already called Labor Board-no help. I don't understand how they could use this when he did not give me a rating over a year ago.

You can appeal the decision of the court to the appeals panel.

Unfortunately for us normal people there are numerous intricacies that may be exercised which result in your un-necessary stress. If you have a current advocate they should be able to assuage your uncertainties. If you don't and this is going to court ya need one ASAP. Respectfully, BAMA07 |

You need a really good attorney. You say Tennessee? Laws differ in all
states but a really good w/c attorney can advise you. Don't take the advice of just one attorney. When you pick your attorney get reference if you can. Try Martindale Hubble and find his rating. An attorney can make all the difference. And in the meantime you start researching information about the w/c laws in your state. You can always call your workmans comp office and ask for some help. They are neutral but they can give you some good advice. You can even go down there and look into your file. You might be surprised at what you find. And most important take notes and make copies of all documents and x-rays, mri etc. They have a way of disappearing. good luck |
