morning all....yes wink, the language is in his comp settlement papers. problem now is stricly settling his medical that was open for life and what to do about investing it and SSD. he will make alot more money investing hence his thought of dropping SSD. he will lose his medicare at that point so we are really afraid to have any of this medical $$$$ put in an set a side with medicare. if he losses it they will have a large chucnk og his money that he'll never be able to use. ithink he's better off settling this medical in a lump in his pocket. his SSD check is just about exactly less than what it should be after deducting what his comp settlement roughs out to over his lifetime. will speak to his attorney today and hopefully come back with answers for all. take your time, i'm not going anywhere.
what i have learned is that in alot of WC cases. it also depends on the size of the co. jayne i would hope a co. as large as pepsi would take care of their employees, in my case, though i work for a large co. my claim was denied soley by my supervisor because we had words the day before and he was still mad at me. this is on record through his depo. him and i butted heads constantly for the past 9 years since he took over. 4 previous comp claims were paid, documented medically and with winesses, and i returned to work full duty. he had no reason to think this time was any different. he denied it out of nothing more than spite because he was mad at me. i wonder what the judge will think when he reads this??????/ so wrong to use your power over an IW. CAP
