Settling Maybe, maybe maybe
My Lawyer is in face to face conference with the WC today about settleing my case. Have ny of you settled with annuities? Anyway please God, there is a chance we could setlle in the next 24-48 hours. My biggest stipulation, besides the cost of my meds, is that they give up at least 50% of thier subjagation rights to my 3rd party case. They say they have already spent 90000 on me and they should get it all back. I don't think that is fair plus it is very likely to take almost everything I get.

Good luck. Typically the best you can do on the subrogation lien in the third party case is 1/3 1/3 1/3. That is, if the case settles for 90k then your lawyer gets 30k, comp gets 30k and you get 30k.
You would then have no WC benefits at all until you burn through your 30k of exposure. I have no idea what the specifics of your case are but if you have a good lawyer, he or she should be able to wrap it all up in a big pretty package closing out the civil and wc cases. Jim |

Depending on the case and the smarts of the lawyer, it is possible to negotiate for less than the 1/3 jaspell spoke of. Also, depending on the size of the settlement, your lawyer may be compassionate enough to lower his percentage of the take. Prayer is a powerful force, Sithie, but sometimes you have to help prayer along the way. Remain close and intent with your lawyer on all of the possibilities. Make certain that you're completely satisfied with the settlement before you sign anything. Sometimes a lawyer will say that's as good as it's gonna get. But sometimes one can play a little subtle poker with his/her lawyer to get more of what is deserved. Just make sure you're not bluffing when you peer over your cards. |

Right now i am waiting for info in the mail from my IC on what they want to offer for a settlement myself. I have no lawyer at this point and have not heard back yet what my rating was that was done on Friday. I was told from the doctor that did the rating that i would still have medical even with the settlement. I am still very curious what is going to come back to me in a few days. It is now a waiting game.
