I posted this on the Off Topic Forum to Spring, but thought it good to post here, also.

I signed my settlement papers for a lump sum this past Friday (Utica Mohawk Language included), with the award of the lifetime medical part left open. I will be assigned a Lifetime Care Manager who will see to it that I will receive any medical care causally related to my back injuries. I am assured that this manager will not be like a nasty adjuster or NCM, as it is now law that I have to be taken care of when needed. Plus that will take care of the Medicare Offset when I file for SSDI. Like you, I agonized over this thing for months--favoring the clincher (to cash out my future medical). But my intuition won the inner battle, and I think that I finally made the wisest decision possible by leaving the future medicals open.

An important question arises now that my lawyer will be getting his percent of the lump sum (to my surprise he only charged me 25% versus the 33.3% that was agreed upon in the beginning) and that is: Will I be left out to dry (without a lawyer) if the IC were to give me any trouble down the road? Well, my lawyer assured me that he will be there for me if need be, even 10 years from now. He's done right by me every step of the way so far, so I'll just have to trust him.

As I related to Spring, I hope this info may be beneficial, in some way, to those who read this.

In regards to the 25% charge - a lawyer I spoke with told me there is a set % rate on wc cases . I cant recall the amounts but it gets less the higher the settlement.

Way to go Wink!!!!!!! That is great news and maybe now you can get on with your life and out of all the WC BS. How long have you been fighting this? I agreed to settle back in June and have yet to sign the settlement papers, Medicare has a lien on my settlement and untill we get that straightened out, and the IC agrees to the wording of my settlement there will be no settlement.............. What a mess I have.

Take care and hope all goes smooth from here on in. You deserve it.

My sister settled 4 yrs ago and her attorney has been there for her any time she has a question or needs anything.
