Thermo, You can Read my signature Below to See the Situation I'm in, and I want to Share Something with You. I did Not want to Face the Fact that I am Disabled, and I had 7 Surgeons (Both Ortho and Neuro.) Look at My Films and One Surgeon Said He would TRY to go in and Clean up My Scar Tissue, and He Told Me I Had a 30% chance of Getting Relief, a 50% Chance of staying the Same, and a 50% Chance it would Make Me Worse. I Had a Second Opinion of this Surgery and the Second Opinion Dr. Asked Me Why would I want to get Cut Back Open with the Odds being So Poor? He then Suggested Pain Management, and that's the Path I chose. The Spine is not Something that should be Manipulated if the Chances are Slim, too many Complications can Occur. I ended up, with the Second Opinion on the surgery, having a Total of 8 now look at My Case, and only One would Try, and when I tried to Research this Surgeon to See His Background, He was so Fresh Out of School that I couldn't even Find any Info. on Him!!! Sorry, I'm not going to be a Practice Patient for Him, especially when dealing with the Spine!! Please think Hard about Your Chances, and whatever You decide, I Wish You the Very Best!!Wink

I agree with you and see how much we have in common. If this was not my spine i would try anything but since this is a place that links my body as a hole i will not let them back in my spine ever again. This is what i tried to explain to the insurance company that i will not be another victim of multiple surges and will not put my family through the process again.....Today they cut my checks off because at court i refused Vocational rehabilitation. I can't work what part of that do they not understand? There own doctor even said i was unable to do any gainful work? Unless i try this full frontal and back fusion where he say i may get better. But i am not going to go by him just saying "HE MAY" get better. That is BS. At the beginning the lied and said the court ordered it when the judge did no such thing. This doctor of the insurance company clearly hung himself by saying in a letter to the judge i was unable to work. And then after the Vocational rehabilitation guy comes here and says i can and the doctor then agrees with him. The nerve off this guy to say that i am 37 years old and am i going to sit on your butt for the rest of your life. I am not going to let this A HOLES get to me. Now i wait for the judges decision as he says he will base it off the medical records. So now we wait. What a great Christmas 3 weeks before they cut my checks. Just pisses me off to no end. They are Heartless thats all i can say.

Well now after 4 1/2 years the insurance company now wants a physic evalutiation. They said they never seen any paper work. I said to them you approved the doctors exam , sessions , paxil, So said well we need a physic exam. The Judge was pissed and said you have 3 weeks thats it. She said 3 weeks. He said 3 weeks then i make my decision. So today i get a letter in the mail and the doctor appt. from the insurance company is 4 days before he makes his decision. You see the games they play. It's sad. Well they have screwed my families Christmas up but like my daughter said to me. Dad we love you no matter what. She is 4 years old. I just hope this Judge does the right thing. To work at these insurance companies must feel good when someone asks what is your employment. They should say yea i work for a workers compensation insurance company. I deny them there rights and make there lives hell.

I am really sorry about your trials and I hope the judge will rule in your favor, but I was told, we can't never refuse Vocational Rehab. We don't have to agree with the counselors but at least we have to try to work with them to show good faith. I am back in Voc Rehab the second time...first one recommended pension but w/c disagrees.
This second firm was told, no matter what, they have to find me a transferable skill and I know they would...my lawyer already prepared to fight in court. This new counselor already tried to tell me, they have training for voice activated computers so I don't have to use my hands a lot.
As for cutting time-loss check..they did it in my case just a few days ago, because they don't have the "right?" attending physician for Voc Rehab purposes. At least that's their excuse.

Thermo and katicagobar, You have to get both of Your Attorneys to Petition the Court for a Return of Your Loss Time Monies until the Ruling of the Judges!! They can't just arbitrarily Cut-Off Payment without due Notice, and a Chance for Your Attorneys to File the Petitions!! Please Contact Your Attorneys A.S.A.P!!! If your doctor and the insurance doctor find your Totally disabled and unable do any gainful employment. This is in a letter from the insurance doctor and my lawyor doctor and SSDI doctor and 5 other surgeons i have seen.Vocational Rehilbilating is for finding you work that you are abled to do.

And what they tried to pull off was me returning to my old job just working on a cnc machine. I returned to work on my own with my doctors permission for about 4 months i could not handle it anymore but also did not know that my disc reruptered and that the pain never stopped. I was hoping it was just surgery pain but i was wrong.


My lawyer said that when i reached MMI they did not no longer have to pay me.

SO many people are injured and must follow the Workers Comp process. in the midist of dealing with, the trails and tribulation of pain, anger, hate and dismay, once the payment hit the bank accounts in a settlement for those who are forunate to receive a settlement. it seems people are more reluctant to respond, or follow up with the pros and cons of the settlement phase to educate others. This system needs repair why cant all injured workers create some logical form of rebelion. not only to be heard but seen in numbers we are the back bone to the work force.

It seems we accept the peanuts they Issue, My I/C sales were 9 Billion dollars which is posted on thier website. Most of the people I have spoken with are fair, most want to work and be compensated for there injury, if this is true what I said,why cant we just come together and fight. I now the I/C will not play fair, but I thought this was the United States Of Anerica!!!!!
