Not meaning to take away from this thread but since you guys are again talking about sex and noone answered my question from one of the last threads, which I was serious about by the way, is loss of sex a compensable consequence to a w/c injury claim?

Typically no- if it does not relate to your job then it is not considered in your WC case. WC is for work related -limits- restrictions and disability.
However there is case law of a 900 operator sueing for WC benefits for carpal tunnel syndrom-this is a fact- and yep that person won thier case.

i appreciate the feedback, very much.

im worried a little however, my current lawyer used to be a lawyer for the "other" side, meaning shes not used to handling these type of cases from the public side, she used to be a laywer for an insurance company, so i know she knows alot about the case, is it an advantage to me that she knows how the other side works? im not sure.

but a little more info on my case, in the end after my WC settled and my doctor let me go, physically i can only do sedentary work.. the job i had before included alot of physical labor, i use to be able to lift heavy objects and push heavy objects, its kinda sad. i havent been really been able to find a job because all i really knew how to do was the job i was doing, i had been there for close to 10 years, so its kinda hard to start over.

dallas, when you say "good" lawyer, in what ways would i be able to know if she is a good lawyer or not? at the moment we seem to lack some communication, i keep thinking that if i dont push her she wont push the insurance company.

loved handling liability cases........maybe I should go back to that…..hope this was not TMI

Dallas is good to know that you know about liability cases i am so lost in this Sad .... like i was in my WC case for almost 2 years because i had many problems and miscommunications with my attorney.
now i am just broke.. because after the settlement that i got from my WC most went to the the mortgage from my house.

I asked my attorney if she is available to tell me aproximately about how much the settlement could be for this civil case ....but she said she had no idea at that time, she had all the medical bills in her hand, is there a reason why she would lie to me? or does she really not know how much my settlement might be for? i understand some lawyers would rather not say how much a case might be worth because at the end the client could call them a liar or told them they promised them a certain amount.

Hi sweetiepie, and you are correct. Attorneys usually don't want to give you a figure unless they know for a fact the actual amount. If they guess too low, you could get upset, and if they guess too high, you are going to be upset. I think that's the way they look at it, not trying to keep you in the dark more than waiting so they can be accurate when they do give you an answer. Who are you suing and why? This will make all the difference on my answer. If this is a civil suit there is a process and that process can take a lot of time or if they choose to settle it will take little time. Has it been filed in court yet or is your attorney still hoping to work out a negotiation?
