I have followed your case for quite a long time now.  I have read and re-read all the posts regarding your dilemma---and if it were me (and I think I said this before) I'd go for it.  Let the judge decide--not your lawyer or the IC.  What have you really got to lose if they're only offering you one pizza a week for the next five years after your lawyer gets his cut???  I don't think I need to spell it all out, for you already know, my Tuffy!

Now...write a letter to your lawyer [Image: 11_1_211v.gif] and tell him how much you love him, and that you know that he will do a good job in court!

Tuffy, I'm sorry I'm so late on this, you probably have a ton of things going through your head right now, and I'm going to throw one more at you. My attorney here in Pa. (who has been very successful in w/c settlements) has told me a VALID spinal injury documented by sound medical evidence should never be settled for less than 6 figures. When I say Valid, I mean not soft tissue damage, a spinal injury that effects the nerves surrounding and the stability of the spine. Reason for this: Future degeneration of the spine due to the injury and the Medical care necessary to treat such degeneration. Just stop and think about what I just posted, and you will see how silly 7,000 dollars is in the scheme of things. Regardless of age and the income you have now, that's what you should be shooting for in my opinion. My case (You can see my injuries in my signature) will settle in the high six figure category. They are not going to walk up and hand it to me, I have been fighting three years and will probably go three more, but that's where it will settle. The question to you is, is it worth the fight? For me it sure is, but you make the ultimate decision!Wink

hi tuffy......after reading limbo's post and also being from PA i can say that all spinal injuries no matter how serious that i know of have all been settled at 6 figures. i understand what you are saying about already being retired and it infuriates me that alot of what goes on involves age discrimination as with SSD so i won't tell you what to do but will support you every inch of the way. i believe wink compared it to pizza???? think long and hard and get all the info and ask all the questions you have of your attorney before you make a decision. i pray for you to have clarity in this.

Thanks all for your replies,    I have made up my mind to continue my fight,   win or loose.   and plan on talking to my attorney and tell him   where the bear---- and the buckwheat.      Now it is back into the IC and my employers hands as I,am passing the buck back to them.     Lets see what happens next.    Again thanks all,    Ilove each and every one of you.

Tuffy, I'm so glad you decided to continue the fight!! There's a lot of money setting on the table for you, just stay strong and fight until you get it. The insurance Co. played their usual game, hit with a ridiculous figure and see if you would take it. Can you imagine how many people without attorneys or a forum like this have accepted these type of settlements because they didn't know any better? It's a shame it has to be this way, but we are going to have to fight for every dime! Keep up the fight and I wish you the Very Best!!Wink
