I need your help

|
I injured my back about two months ago and I go to the doc and physical therapy like 5-6 times a week. This case is in Indiana. I told my PT this morning that I was going very broke and need to get back to full-time work, he said " Is the wormans comp not giving you enough" I replied " I haven't received or been notified about a dime, the bills come in my bank account goes down and not much goes back in the bank right now". So my question is I worked around 60 hours a week before this happened and now average 15-20 hours a week because with my restrictions they run outt of work and send me home. Is there anything I can do? Am I entitled to anything? I think everyone has noticed the price of gas and I have to go to the next town over to see the doc and I can't even hardly afford the gas anymore. Broke and wondering if I'm screwed or if there is something I can do. Thank you for your help!!!!

Hi Johnny, sorry to have to meet you this way. I'm not sure how much I can help, but I know someone else will be along who can. You need to go to the top of the page and read about your specific state. In Kansas, I get paid mileage to go to drs appointments and therapy. I also thought that if you weren't able to work full time, w/c had to pay the difference. Like I said, I am not sure about your state, but someone will. I wish you the best.

You should be getting tpd - temp partial disability up to the state max - also no sure on mileage in Indiana if it is out of town or out of the county off hand - hopefully 1171 can answer that.

I assume you filed a written report with your employer.
Did you? If not, make sure they are aware the the injury is from work and a they need to notify their insurance carrier. who is their carrier? did they file? The insurance carrier is required to report your claim to the state work comp board as soon as you lose even one day of work. Has that been done? You are entitled to both temporary total and temporary partial disability as long as the doctor has taken you off work or put you on restrictions: Temporary Total Disability (TTD) is paid for the time period an employee is completely unable to perform his or her regular work because of an injury. TTD is paid at the rate of two-thirds (2/3) of the employee’s pre-injury average weekly wage, subject to a maximum period of 500 weeks. Temporary Partial Disability (TPD) is paid when the employee is partially unable to work for the employer the employee was working for at the time of his injury. For example, an employee’s injuries might limit the number of hours she is able to work, or might mean that the employee is temporarily assigned to a job that pays less than her pre-injury job. TPD is paid at the rate of two-thirds (2/3) of the difference between the employee’s pre- and post-injury average weekly wages, subject to a maximum period of 300 weeks. Indiana has a 7 day waiting period: When a compensable injury renders an employee unable to work, compensation for lost wages is paid starting on the eighth day. However if the employee is still disabled, on the twenty-second day after the injury, the employee will receive compensation for the first seven days. They have time limits to pay you or they are penalized but you have to make sure the claim has been reported and the doctor has given them current medical information: The first weekly installment of compensation is due fourteen (14) days after the disability begins. Not later than fifteen (15) days from the date that the first installment is due, the employer/carrier must tender to the employee an Agreement to Compensation, along with compensation due, or request an extension of time. all the basic information about Indiana work comp rules are in their handbook http://www.in.gov/workcomp/employees/ |

Thank u all for the info and 1171 you get a special thanks, but wondering does this go back to when I first got hurt, they know I got injured at work and are taking care of doc bills but keeping me in the dark about my rights (imagine that) I just hope that this goes all the way back to when this started because I hae lost alot of money. I don't want to take legal action I just want what is mine.

Since this has been going on for two months I would think that it would go all the way back. From what I have seen, employers and the insurance company don't like to give out information. That's why it is best to try to read up on your state (they can be hard to understand) and ask questions. See if your state has an obudsman. They may be able to help you understand. Best of luck!
