IC may think the longer they hold you off, depending on your age, the likelihood of you needing a 2nd or even a 3rd would be in doubt, saving them money. As I come to a close with my experience with WC, I need to make sure that my next TKR surgery is covered.
On the other hand, if they wait any longer, as happened with me, the exaggerated gate I had as I walked has caused other body part issues, back, other knee and even shoulders, as I am sure you are experiencing. Adding these issues certainly could add to your WC claim in the future, if you don’t get the attention needed for your knees. I have no lawyer, and am struggling with the concept, as I posted in a separate thread. I am just confused with what direction to go to protect myself, I feel I am a fairly intelligent man and can fend for myself, and if there is a settlement in my future, do I want to share it after handling it this far on my own. |

I was released 3 months after surgery, no rating or restrictions.
I had meniscus tears and other injuries of the left knee. Only problem was when I was released I was was having difficulity weight bearing. I hired an attorney and was sent for an eval, was found to need bilateral knee replacements and doctor said I was unable to work. Next week I have an appointment as the judge is sending me to a doctor for an eval. Last time I had an eval it took 5 months for the judge to recieve the doctor's report. |
