#1
I fell @wrk oct 2014 coming in frm mandatory fire drill . 45 hrs old then. Feb 2015 had total knee replacement. Had scar tissue removal july 2015. Was off work 1 year returned feb 2016. In may 2016 doc took back wrk til employer made accomodations to wrk area and had ergonomic specialist examine area. Came back to wrk aug 2016 doc released with perm restrictions.. Lawyer had to go back i to court to request doc appt due to excessive swelling and knee popping judge granted doc appt to dif doc jun 2017..he snt me for more therapy rleased me wit same perm restrictions sept 2017. Few days later my supervisor called me into her ofc and told me since doc has released my wc case lawsuit is over and no restrictions. Case not closed have not been to court yet..My boss has underhandedly done things to make life semi miserable. She has caused me so much stress that i hVe developed severe migraines and my asthma is getting worse. So much so my primary care doc has given me fmla paperwrk. My supervisor is still pressuring and making stress worse. I have wrked for state of oklahoma for 22 yrs i am not yet eligible for retirement but wrked to long tbere to just quit. What can i do. My job is the type of place that will tdy to get you for suing. I fear my doc is going to have to place me on anxiety meds along with all that is going on..Also does anyone on here hVe any idea wht the settlemnt amt may be for my type of injury..

It's impossible to predict future benefits before your condition has stabilized.
You will receive a permanent impairment rating when you have reached maximum medical improvement.
The rating will be used to calculate your additional disability benefits.

You can contact a counselor about filing a discrimination complaint.

Your atty should be advising you of your options.
unfortunately you live in a republican state where collective bargaining for state workers has been disallowed.
Many states still have those resources to protect against retaliatory behavior.
you still have rights under ADA to meet with the employer about reasonable accommodation

They are blatantly trying to run you out because of your injury. Fill out an EEOC complaint form and even though I do not use one, get an employment attorney and make him know you are being discriminated against for filing a workers compensation claim. It is illegal to retaliate.

I filed against the state of CT. as I too am a now disabled, retired state employee, BUT I did not leave with nothing. There is a gag order on my EEOC/CHRO complaint so I cannot disclose the terms of the settlement.
SSD was approved in 2 years and I made sure to NOT stip out ANY WC injury in the CHRO settlement. I thought of it and told them to write it in or I am going back on the news!
I have had 2 major spinal surgeries since all of this went down.

You have to file within 6 months (180 days) of the supervisor doing this to you.
You should also call for a WC hearing and tell on them.
Keep a journal of dates and behaviors they commit against you.
Details matter later on.

Please do not sit back and take this.
I know it is emotionally draining and you are frustrated and feel like they are trying to make you out like you are a problem. Do not back down.

My case is now precedent in Connecticut at the Commission on Human Rights & Opportunities.
Connecticut Women's Education & Legal Fund helped me for free. (CWEALF)

SEIU union called me and told me, "you brought about real change due to your complaint and we are calling to thank you for all you have endured."

I am here to say, that a certain governor is now sitting in the clinker for his retaliation against state employees.
You have RIGHTS my friend.
Talking to attorneys is free.....ask around who is worth talking to, because some are lazy.
I wish you all the strength in the world.
