settlement not final yet
I am a medically retired California State Employee. I was put on permanent and stationary status over a year ago. I know I am an unusual case being that every agency involved has been great! and I have not had to seek an attorney yet?. Workers comp put both my knees from seperate injury dates onto one claim, which is now just one settlement, and I have been recieving payments from them every two weeks. My question for anyone?, is that my knees have gotten worse!. Working my new job with no problem's for 10 months now, suddenly yesterday my left knee filled up with fluid and swelled up almost as much as the first time this whole issue started 4 years ago. I see the doctor on monday, and my case a WC has not gotten final approval yet. Being that my condition is getting worse and affecting my employment options even more now, should I get a lawyer and re negotiate my claim?. Has anyone gone through this scenario before?.

have you signed off on your claim?Calif laws are really different....someone will be along in a bit be patient.......mean while go down to the off topics and have fun with the rest of the group

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

It depends on if the current condition is related to recent work activities or the prior injuries/conditions. You may "new and further" disability on the existing claims or a new claim. Those are medical questions for your doctor.
