Employer avoiding using workmans comp
(08-07-2018, 01:59 PM)1171 Wrote: unfortunately Xrays and MRIs in themselves are not evidence of pain or disability.
Many people have abnormal radiology yet no discomfort, pain, or loss of function.
they are tools and only a part of a doctor's diagnosis and opinion.
if the doctors, employers, carriers, etc. are not supporting your claim, then the comp system can do little to provide benefits until there is decision by the comp court.
you might try looking for help outside of workers compensation insurance for benefits.
here is one

if your health insurance won't step in to cover denied care and you can't afford to pay out of pocket, you might try your county social services or

your atty maybe be able to offer other resources until your claim is decided.

SSDI is available for those who are out of work for a year or more.
Thank You, for the reply and information you gave me., I do have insurance, carrier is covering my shoulder. SSDI is another thing my attorney is looking into . The carrier is supporting the claim. Just so aggravated by having to see several Dr's. and specialists. It has been a nightmare. I will look at the sites you posted thanks again.

Having shoulder surgery next week, then more therapy. My neck is ignored yet once again. Unbelievable. i am searching for a dr who will look at the whole spine, neck, hip, and back. It is all out of wack. The chiropractor has the x-rays to prove it. Getting a doctor to look at the whole body structure is another freaking joke. Can a chiropractor rate your disability rating is my question?

Good luck Tina.. I'm being sent back to Pain Management for my lower back.. I now have a 4th disc involved and it seems my surgeon or his PA doesn't want to do a thing.

yes, as a designated physician a doctor of chiropractic can perform a disability rating. your atty is the best one to decide if they should.

Thank you. I go today to get stitches out and therapy again for the third round of it!!. The case manager will attend ,but is forbidden to be in exam room with me and the doctor. I'd like to give them all a head full, but i cant......Attorney says one thing at a time. I need to find a spine doctor that deals with the whole spine. the arm frozen shoulder is caused from neck, and until they figure that out I am doomed!!!

The Shoulder surgeon is referring me to a neurosurgeon for neck. Comp nurse says they will deny it most likely. I went off on her. I said if the attorney can read all the reports it is in Black and white! If not, Maybe I need to show him that the neck is and has been reported to doctor from day ONE along with the shoulder, and I told the supervisor at work, which she was treating me with bio freeze for it!
I am livid, and getting worse now, from Physical therapy addressing my shoulder while it is causing more damage to my neck... I must contact shoulder doctor and tell them therapy has to stop on shoulder until my neck gets some relief!
I have SEVERE foraminal narrowing in c5-c6 Moderate in c4...
I am mentally and physically exhausted from all of this BS...I know a bunch of you are too... Lawyer says will have to see the judge most likely to get approved, in the mean time I am suffering...UGH

Thank you, it is so unlawful for these companies to deny the PROOF of an injury that is in black and white, but they do it! i wish you a speedy recovery and some help soon!
