Mel...It is then 70% of your gross pay. I'm sorry I had to explain it like this but felt you are so unsure of what's going on I wanted you to know that this is all normal and sometimes it gets worse before better. WC is a no fault system that plays with the IW 's life. Sorry to seem so negative , it isn't always, but at times it's horrible. Just wanted you to be aware of what COULD happen if the IC denies your claim. Mel...I injured 5 body parts. Had medical documentation to back everything up, had a panel Dr. verify it all, even the IC's IME was in my court and they still denied my claim. I had to wait for a Judge to make the decision and actually I was very lucky that I only held on waiting for 14 months. My husband waited 3 years and of course making alot more than I did, we thought we would lose everything as so many others have crossed here. We 're her for you. The IC could send you a check at any time BUT the Oct. 11th date I'm using is the end of their time limit. I hate to tell you this but you will definitely need an attorney if they don't accept your claim and pay you by then. That's why I suggested talking to one now this way just in case the IC denies your claim you are ready for action. It's so scary and frustrating. Hang in there. We are all here for you.

mel ...the one good news I can give you interms of what happened to us in nj and of course remember that nj has several acceptable W/C IC and they may all process this differently. Recieving a TTD check was never an issue. Our first one came at the end of 14 days on the nose and then every week there after until he was found to be at MMI. Remember that every state is different in terms of how they process W/C claims. I am going to see if I can find where it says what our state does..if it takes the whole 21 days or not... I will give you a site if I can find it.

You are going to have an issue with the fact that they all knew about it and then told you to use your private insurance. Best Wishes... Red

mel I copied the below information from the question and answer section of the W/C Injured workers section of the NJ web site... this says that you should recieve a check in 14 days. I could not find if this is 14 days from the waiting period but I don't think so. i do remember that my husband recieved his at 14 days on the nose...the reason I know this is because he was hurt on a payday and then he received his first TTD check on what should have been his next pay day and he got paid everyother week on his job. After that they came on 7 days apart on the nose.

I apologize if I sound negative... I just don't have a lot of good things to say about what happens in NJ with W/C and their IC. There is one company that I know has a very high denial rate... Best of luck. Red

How long do I have to wait before I receive benefits from my employer or their insurance carrier?

Generally, you can expect to wait two weeks before receiving temporary disability benefits. If your employer or their insurance carrier unreasonably and negligently delays denial of a claim, they may be liable to you for an additional amount of 25% of the amounts due plus any reasonable legal fees incurred in relation to the delay. A delay of 30 days or more is presumed to be unreasonable.

well this is the question the company is being more then easy with timing and they filled out the report immediatley when i went back to work and told them to.......the hr guy know he screwed up so he wants to do everything he can to cover himself meaning being extra nice to me so what your saying is i should have a problem getting ttd checks??

No that is not what I am saying. As you said later, they all screwed up and HR knows it. What he told you to do was illegal. THere fore I think that in time this person will change there mind about how things happened to cover there themselves if that makes sense. i would be very cautious and keep everything thing. I would get a copy of the report that was filed. I would want a copy of the employee handbook, and I would keep a log by my phone and in my purse to document every call you receive from this person or anyone from W/C or about W/C. This may just help you in the end. Right now, there is no conclusion as there where your case is going to go, but the minute it looks like a big case or there is more here I fear that you will have some issues with the W/C IC and HR will not continue to be nice persey.... just some thoughts. Just CYA all the way...Red
