I have worked for this company for 7 years and was the Senior employee.(as in been there longer than anyone else) Did anything for this company, enjoyed working there very much. After about 6 years I began have severe shoulder pain, and seeked medical advice. Confronted my employer that I "may" need to file Workmans Comp. But my husband has good insurance so I wasn't all that concerned and had been told that it was more of a headache to file than it was worth. I told my Dr. as well. Meanwhile....MRI's, Cat Scans, Xrays, Physical Therapy, and Cotisone shots later....Came down to surgery. I had also left my job about 2 months later for several other reasons. Then I had the surgery, with my Bursa removed from my shoulder, bone spurs, and a tear that was reparied. All this leaving my mobility to a minimum. I am still unemployed, and tried for unemployment but was declined. I am very limited with what I can do for work until my shoulder heals completely which is expected to be 3-6 months. My question to anyone out there is, Do I have any rights or is there anything I can do?

]There are time limits under your states work comp law for filing a claim both with the employer as well as with the work comp commission or board. Each state has different rules and limits. Without knowing your state it is impossible to say. You can contact your states work comp agency to find out the filing requirements.

Even if you are within the legal time frames you will need a medical opinion documenting that your condition was caused by the job

I am in Arizona. My Dr. knows this was work related as well as the company.
