Hello - I have been disabled for the past 5 months with a knee injury. I broke my knee cap and torn the meniscus.

With my last doctor visit, I was released to go to work but had a 40lbs weight limit set on me. I'm not 100% but she released me to work. I work for Sears doing appliance delivery, and when I talked to my boss she said that there is nothing I can do it my area as everything is well over my 40lb limit and there are no other positions for at the time, and should be receiving my next compensation check by now, but haven't yet.

So my question is, am I jobless now, and need to start looking for a new one? Has my compensation stopped?

Each state has its own work comp laws and regulations; some states will pay if the employer has no light work and with others you are on your own.
The first thing you need to do is notify the work comp carrier of your status and situation. If they were told you were going back to work and you are not, they need to know that.

It would help if you said what state you are in. Were you released with any other restrictions? Are you on light duty, medium duty or full duty with just the 40 pound restriction. Are you at MMI? Need more info, so everyone with the knowledge on this forum can respond to you accurately.

Personally, when I return with a list of restrictions and my employer didn't have work under those restrictions, I received compensation until they could accommodate me.

Sorry I forgot to mention it, but I'm in Arizona. I was released to work under light duty with the 40lb limit. Sorry, but I'm unaware of what "MMI" stands for...? I just tried to contact the claim holder but got the machine so I left a message about this concern.

I really wish this hadn't as its not just me with problems in my family and times are tough enough as is.

You might want to also look at the top of the forum page, there is a place with "info by state", this would be worth reading. Learn all you can about the WC system and your states laws and statues

MMI, if I'm correct is Maximun Medical Improvement, it doesn't necesarily mean that your 100%, but that the Dr. can't do anymore for you at this point.

You may want to consider talking to a WC certifed lawyer, most states have them that will give free consults. It wouldn't hurt to ask one some of your concerns.
